Stat. tit. 82, § 82-561","heading":"Appointment of directors - Election of successors","body":"Within thirty (30) days after entering the decree incorporating\n\nsaid district, the judge having jurisdiction shall call an election\n\nof a temporary board of directors, and cause notice thereof to be\n\ngiven by publication thereof in each county in which lands of the\n\ndistrict are situated, the last insertion to be not less than thirty\n\n(30) nor more than sixty (60) days before the date of such meeting,\n\ncalling a meeting of all of the owners of land within the district\n\nat a day and hour specified, at some place in the judicial district\n\nin which the district was organized, for the purpose of electing a\n\ntemporary board of three (3) directors who shall be residents within\n\na county in which the district is located and shall be owners of\n\nland within the district; provided, that not more than one director\n\nshall be chosen from any one county affected by the district, if\n\nthere are more than two counties affected by the district. The\n\ndistrict judge shall conduct the election and at such election each\n\nand every owner of any land within the district shall be entitled to\n\none vote for each director, in person or by proxy in writing, duly\n\nsigned and verified by affidavit. The owners of land voting in such\n\nelection, either in person or by proxy, shall constitute a quorum\n\nfor the purpose of holding such election. The directors elected\n\nshall serve until the first permanent board of directors is elected,\n\nas hereinafter provided.\n\nWithin twenty (20) days after the confirmation of appraisements\n\nof benefits for said district, the court clerk of the district court\n\nin which the petition has been filed, or to which it has been\n\nassigned, shall give notice, as heretofore provided, calling a\n\nmeeting of the owners of all the lands on which appraised benefits\n\nhave been confirmed situated in said district, at a day and hour\n\nspecified at some public place in the judicial district in which the\n\ndistrict was organized, for the purpose of electing a permanent\n\nboard of three (3) directors who shall be residents within a county\n\nin which the district is located and shall be owners of land on\n\nwhich appraised benefits have been confirmed. The president of the\n\ntemporary board of firectors shall, in open court and under the\n\nsupervision of the district judge, conduct the election, and at such\n\nelection each and every owner of any lands on which appraised\n\nbenefits have been confirmed shall be entitled to one vote for each\n\ndirector, in person or by proxy in writing duly signed and verified\n\nby affidavit. Said election shall be for terms of one (1), two (2)\n\nand three (3) years, and thereafter the terms of directors shall be\n\nthree (3) years from the date of said election and they shall serve\n\nuntil their successors shall have been elected and qualified as\n\nhereinbefore provided.\n\nEach year the court clerk of the district court shall give\n\nnotice, as heretofore provided, for the yearly election of the\n\nDirector whose term expires. The director with the longest term\n\nleft shall, in open court and under the supervision of the district\n\njudge, conduct the election.\n\nThe Oklahoma Water Resources Board at any election or meeting\n\nmay represent the State of Oklahoma and shall have the right to vote\n\nfor directors or in any matter that shall come up properly before\n\nany election or meeting to the extent of the assessment against land\n\nowned by the state in such district, which vote may be cast by any\n\nperson designated by said Oklahoma Water Resources Board; guardians\n\nmay represent their wards, executors and administrators may\n\nrepresent estates of deceased persons, and private corporations may\n\nbe represented by their officers or duly-authorized agents; and any\n\ncity, county or municipality may be represented by its officers or\n\nagents duly-authorized.\n\nThe owners of land on which appraised benefits have been\n\nconfirmed, voting in the election of a permanent board of directors,\nr wards, executors and administrators may\n\nrepresent estates of deceased persons, and private corporations may\n\nbe represented by their officers or duly-authorized agents; and any\n\ncity, county or municipality may be represented by its officers or\n\nagents duly-authorized.\n\nThe owners of land on which appraised benefits have been\n\nconfirmed, voting in the election of a permanent board of directors,\n\neither in person or by proxy, shall constitute a quorum for the\n\npurpose of holding such election or any election thereafter. The\n\npersons receiving a majority of the votes cast in any election shall\n\nbe elected, and the district judge under whose supervision the\n\nelection is held shall make and enter an order setting forth the\n\nresults of said election, naming the elected Directors and\n\nspecifying their respective terms.\n\nAny director appointed or elected may be removed by the district\n\njudge having jurisdiction of the conservancy district, for\n\ndishonesty, incompetency or failure to perform the duties imposed\n\nupon him by this chapter, and any vacancies which may occur in any\n\noffice shall be filled by appointment by the district judge having\n\njurisdiction of the district for the unexpired term of said\n\nDirector, such appointee to be qualified as herein set forth.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"611aca6fb2cc6b70c58706a8754cb6f9eb1728ead85c66a215bbf5405e42999b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-549","next":"us-ok/okla.-stat.-tit.-82-82-562"},"notice":"GroundRules: Original legal text.
