Stat. tit. 82, § 82-565.1","heading":"Dissolution of conservancy districts","body":"A conservancy district created under the provisions of the\n\nConservancy Act of Oklahoma may be dissolved by the district court\n\nhaving jurisdiction of said district, upon an application for that\n\npurpose filed by a majority of the members of the board of directors\n\nof such district, or upon the petition of a majority of the\n\nlandowners in such district. Any such application shall be in\n\nwriting and shall set forth either that a plan for the improvements\n\nfor which the district was created has not been prepared and that\n\nthere is little likelihood that such a plan will be prepared within\n\nthe next three (3) years; or, that a plan has been prepared but no\n\nassessments have been approved by the court and that a period of ten\n\n(10) years has elapsed since approval of the plan and that there is\n\nlittle likelihood that such assessment will be made against the\n\nbenefited land within the next three (3) years. Such application\n\nshall further set forth that all indebtedness of said district has\n\nbeen paid in full and that said district has no indebtedness\n\noutstanding and that it will be in the best interests of all\n\nlandowners within said district to have the district dissolved. Said\n\napplication must be signed by a majority of the members of the board\n\nof directors, or by a majority of the landowners within such\n\nconservancy district. Said application shall be filed with the\n\nclerk of the district court having jurisdiction of such district. If\n\nthe judge of the district court having jurisdiction of such district\n\nis satisfied that the application is in conformance with the\n\nprovisions of this act, he shall order the clerk of said court to\n\ngive notice by publication, to be made of the pendency of the\n\napplication and of the time and place of the hearing thereon, and\n\nsaid notice as provided herein shall be given in each county\n\naffected by the district and the time of hearing shall not be less\n\nthan sixty (60) days from the date of the first publication. Any\n\nowner of land in said district who desires to object to the\n\ndissolution of said district shall, before the date set for the\n\napplication to be heard, file his objections and state the reasons\n\nwhy such district should not be dissolved. Upon said hearing, if\n\nthe court finds from the evidence presented that the application has\n\nbeen signed by a majority of the members of the Board of Directors\n\nor by a majority of the landowners in said district and either that\n\na plan for the improvements for which the district was created has\n\nnot been prepared and that there is little likelihood that such a\n\nplan will be prepared within the next three (3) years; or, that a\n\nplan has been prepared but no assessments have been approved by the\n\ncourt and that a period of ten (10) years has elapsed since approval\n\nof the plan and that there is little likelihood that such assessment\n\nwill be made against the benefited land within the next three (3)\n\nyears, and if the court further finds that all indebtedness of said\n\ndistrict has been paid in full and that said district has no\n\nindebtedness outstanding and that it will be in the best interests\n\nof all landowners in the district to have the district dissolved,\n\nthe court shall declare said conservancy district dissolved.
