Stat. tit. 82, § 82-568","heading":"Protection, reclamation or irrigation of lands - Petition","body":"and notice of action.\n\nA. In order to effect the protection, reclamation or irrigation\n\nof the land and other property in the district, the board of\n\ndirectors is authorized and empowered to:\n\n1. Clean out, straighten, widen, alter, deepen or change the\n\ncourse or terminus of any ditch, drain, sewer, river, water course,\n\npond, lake, creek or natural stream in or out of the district;\n\n2. Fill up any abandoned or altered ditch, drain, sewer, river,\n\nwatercourse, pond, lake, creek or natural stream;\n\n3. Concentrate, divert or divide the flow of water in or out of\n\nthe district;\n\n4. Construct and maintain main and lateral ditches, sewers,\n\ncanals, levees, dikes, dams, retardation dams, irrigation dams,\n\nsluices, revetments, reservoirs, holding basins, floodways, pumping\n\nstations and siphons and any other works and improvements deemed\n\nnecessary to construct, preserve, operate or maintain the works in\n\nor out of the district;\n\n5. Construct or enlarge or cause to be constructed or enlarged\n\nany and all bridges that may be needed in or out of the district;\n\n6. Construct or elevate roadways and streets;\n\n7. Construct any and all works and improvements across, through\n\nor over any public highway, canal, railroad right-of-way, track,\n\ngrade, fill or cut, in or out of the district;\n\n8. Remove or change the location of any fence, building,\n\nrailroad, canal or other improvements in or out of the district; and\n\n9. Hold, encumber, control, acquire by donation, purchase or\n\ncondemnation, construct, own, lease, use and sell real and personal\n\nproperty, and acquire, construct, own, lease, use or sell any\n\neasement, riparian right, railroad right-of-way, canal, cemetery,\n\nsluice, reservoir, holding basin, mill dam, water power, wharf,\n\nholding basin or franchise in or out of the district for right-of-\n\nway, or for any necessary purpose, or acquire, own, lease, use and\n\nsell any real estate for material to be used in constructing and\n\nmaintaining said works and improvement, replat or subdivide land,\n\nopen new roads, streets and alleys, or change the course of any\n\nexisting one.\n\nB. All engineering, planning, design and execution, the\n\noperations of the district, and the construction, operation, and\n\nmaintenance of infrastructure to serve the purpose for which the\n\ndistrict was established, or to serve any purposes as may have been\n\namended from time to time as provided for in this act, may be\n\nimplemented at the discretion of the board of directors under the\n\nadministration of the district manager. Except for engineering,\n\noperations, and the construction, operation and maintenance of\n\ninfrastructure to implement its approved purposes, the board of\n\ndirectors shall not exercise any of the powers specified in this\n\nsection without first filing in the court having jurisdiction a full\n\nand complete petition stating in detail the acts intended to be\n\ndone. Upon the filing of the petition, a notice shall be published\n\nin the county or counties in the district, as hereinbefore provided,\n\nsetting forth the nature of the relief prayed for, which notice\n\nshall be published for not less than thirty (30) days, and shall\n\nspecify a date on which the petition will be heard by the court. In\n\nthe event a protest is filed, the court shall hear all parties\n\ninterested and make its decree. The court shall base its decision\n\non the petition, granting the relief sought in whole or in part, or\n\ndenying the relief prayed for, upon whether the proposed action of\n\nthe district lies within the scope of its authority pursuant to this\n\nact and the agreements and decrees establishing the district and\n\ngoverning its operation.
