Stat. tit. 82, § 82-602","heading":"Appraisals, how made - Duties of appraisers","body":"(a) During the preparation of the official plan, the board of\n\nappraisers shall examine and become acquainted with the nature of\n\nplans for the improvement of the lands and other property affected\n\nthereby, in order that they may be better prepared to make\n\nappraisals.\n\nWhen the official plan is filed with the secretary of the\n\ndistrict, he shall at once notify the board of appraisers, and they\n\nshall thereupon proceed to appraise the benefits of every kind to\n\nall property within or without the districts which will result from\n\nthe organization of said district and execution of the official\n\nplan; provided, however, that in the case of a district composed in\n\nwhole or in part of municipal corporations, state or federal\n\ninstitutions, and/or political subdivisions, the board of appraisers\n\nmay, in lieu of appraising benefits against each separately owned\n\nparcel of realty situated within the same, appraise the benefits as\n\na whole to all property situated within the boundaries of said\n\nmunicipal corporation, institution and/or political subdivision. In\n\nsuch event, the benefits appraised as a whole shall be considered as\n\nbenefits to the municipal corporation, institution and/or political\n\nsubdivision. It shall be the duty of the governing body of the said\n\nmunicipal corporation, institution, and/or political subdivision to\n\ncollect assessments levied on the appraisal of benefits, as provided\n\nin the Conservancy Act of Oklahoma. Provided, however, that to the\n\nextent legally permissible, as now or hereafter provided, such\n\nmunicipal corporation, institutions and/or political subdivisions\n\nmay pay such portion of any assessments levied under the provisions\n\nof this act from funds and revenues otherwise collected and held by\n\nthem, to the extent such manner of payment is deemed desirable. In\n\nthe progress of their work, they shall have the assistance of the\n\nattorney, engineer, secretary and other agents and employees of the\n\nboard of directors. The board of appraisers shall also appraise the\n\nbenefits, if any, accruing to cities, villages, counties, townships\n\nand other public corporations, as political entities and to the\n\nState of Oklahoma.\n\nThe appraisers in appraising benefits shall consider only the\n\neffect of the execution of the official plan. The appraisers in\n\nmaking appraisals of benefits shall give due consideration and\n\ncredit to any other works or of the systems of reclamation already\n\nconstructed or under construction which form a useful part of the\n\nwork of the district according to the official plan.\n\n(b) While making the appraisal of benefits as above provided,\n\nthe board of appraisers shall, if directed by the court, estimate\n\nthe damages to be substained to each tract of land and to other\n\nproperty which will result from the execution of the official plan,\n\nincluding an estimate of the damages to be sustained by the taking\n\nin fee simple of the title to, or of an easement over any land\n\nspecified by the board of directors as desired to be so taken, for\n\nthe execution of the official plan; and the board of appraisers\n\nshall make a separate detailed report of the same to the clerk of\n\nthe court, and to the board of directors for its guidance in\n\nthereafter fixing the payment of such damages or in determining to\n\nproceed by condemnation as provided in Section 607 of this title.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"54a7b20734b0aedd7c23b5a04dcc3169656b10503eb387814708ec99ce0d36a3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-601","next":"us-ok/okla.-stat.-tit.-82-82-603"},"notice":"GroundRules: Original legal text.
