Stat. tit. 82, § 82-616","heading":"Defects and irregularities, how cured","body":"No fault in petition or any notice or other proceedings shall\n\naffect the validity of any proceedings under this act, except to the\n\nextent to which it can be shown that such fault resulted in a\n\nmaterial denial of justice to the property owner complaining of such\n\nfault, and except as to matters concerning the acquirement of\n\noriginal jurisdiction of the district.\n\nIn case it is found upon a hearing that by reason of some\n\nirregularity or defect in the proceedings the appraisal has not been\n\nproperly made, the court may nevertheless on having proof that\n\nexpense has been incurred which is a proper charge against the\n\nproperty of the complainant render a finding as to the amount of\n\nbenefits to said property, and appraise the proper benefits\n\naccordingly, and thereupon said land shall be assessed as other land\n\nequally benefited, if original jurisdiction has been acquired and an\n\nappeal shall be allowed as is provided in the case of the original\n\nappraisement. In the event that at any time either before or after\n\nthe issuance of bonds pursuant to the provisions of this act, the\n\nappraisals of benefits, either as a whole or in part, be declared by\n\nany court of competent jurisdiction to be invalid by reason of any\n\ndefect or irregularity in the proceedings therefor, whether\n\njurisdictional or otherwise, the said district court is hereby\n\nauthorized and directed on the application of the board of directors\n\nof said district or on the application of any holder of any bonds\n\nwhich may have been issued pursuant thereto, properly and without\n\ndelay to remedy all defects or irregularities as the case may\n\nrequire, by directing and causing to be made in the manner\n\nhereinbefore provided, a new appraisal of the amount of benefits\n\nagainst the whole or any part of the lands in the said district as\n\nthe case may require.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b92f5592c070c4a9824e032ba67ae7da87f2fb2936f1b57aba0f77c5fe7865d6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-615","next":"us-ok/okla.-stat.-tit.-82-82-630"},"notice":"GroundRules: Original legal text.
