Stat. tit. 82, § 82-631","heading":"Abandonment of project - Sale of lands and property","body":"In case any such project, or any part thereof, be abandoned as a\n\nflood control project, or in the event any land and property\n\nacquired by purchase or condemnation in fee simple shall no longer\n\nbe necessary for the purposes of the district, the same shall not\n\nrevert to the former owner or owners or their subsequent grantees of\n\nthe property but shall be sold at public sale to the highest bidder\n\nby the board of directors subject to confirmation by the court, with\n\nthe proceeds to be paid into the improvement fund created by Section\n\n630 of this title; provided, however, members of the board of\n\ndirectors and agents, servants and employees of the district shall\n\nhave no right to acquire such lands. The former owner shall be\n\ngiven thirty days (30) notice by certified or registered mail of the\n\nsale, and of his right within ten (10) days after the sale to file\n\nan election with the court to buy the land at the highest bid price.\n\nIf the address of such owner is unknown then said notice shall be\n\ngiven by publication for two (2) consecutive weeks in a newspaper of\n\ngeneral circulation in the county in which the land is located. Such\n\nformer owner shall have ten (10) days after such sale to file an\n\nelection to take such land at the highest bid price; and unless such\n\nelection is filed within said ten-day period, such rights shall\n\nexpire and the court shall confirm the sale free of such right. Such\n\npreference right and the requirement that a public sale be held\n\nshall not apply if the sale is made to any agency, department or\n\ninstrumentality of the State of Oklahoma; and a district may sell,\n\ntransfer or assign property of the district, subject to confirmation\n\nof the court, to the State of Oklahoma or any agency department or\n\ninstrumentality thereof by resolution of the board of directors of\n\nsaid district.\n\nWhere lands or interests therein are acquired by the district\n\nand not utilized for the purposes for which it was acquired, or\n\nwhich have been utilized but such utilization has ceased, then,\n\nafter ten (10) years from the date of acquisition, or ten (10) years\n\nfrom the date utilization ceased, as the case may be, such land must\n\nbe sold at public auction to the highest bidder; and mandamus by any\n\ninterested party will lie to require such sale.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"24c56e89bbb6469976dedf0075da68a33f2144a89496a2a5b9f82be50fab80ee","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-630","next":"us-ok/okla.-stat.-tit.-82-82-632"},"notice":"GroundRules: Original legal text.
