Stat. tit. 82, § 82-638","heading":"Petition for readjustment of maintenance assessment -","body":"Notice and hearing.\n\nWhenever the owners, or representatives of twenty-five percent\n\n(25%) or more of the acreage or value of the lands in the district\n\nshall file a petition with the court clerk in whose office the\n\npetition was filed, stating that there has been a material change in\n\nthe value of the property in the district since the last previous\n\nappraisal of benefits, and praying for a readjustment of the\n\nappraisal of benefits for the purpose of making equitable basis for\n\nthe levy of the maintenance assessment, the said clerk shall give\n\nnotice of the filing and hearing of said petition in the manner\n\nhereinbefore provided.\n\nUpon hearing said petition if said court shall find there has\n\nbeen a material change in the value of property in said district\n\nsince the last previous appraisal of benefits, the court shall order\n\nthat there be a readjustment of the appraisal benefits for the\n\npurpose of providing a basis upon which to levy the maintenance\n\nassessment of said district. Thereupon the court shall direct the\n\nappraisers of the conservancy district to make such readjustment of\n\nappraisal in the manner provided in this act, and said appraisers\n\nshall make their report; and the same proceedings shall be had\n\nthereon, as nearly as may be, as are herein provided for the\n\nappraisal of benefits accruing for original construction. Provided,\n\nthat in making the readjustment of the appraisal of benefits said\n\nappraisals shall not be limited to the aggregate amount of the\n\noriginal or any previous appraisal benefits, and that after the\n\nmaking of such readjustment of limitations of such annual\n\nmaintenance assessment to one percent (1%) of the total appraised\n\nbenefits shall apply to the amount of the benefits as readjusted;\n\nand provided, further, that there shall be no such readjustment of\n\nbenefits oftener than once in ten (10) years.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"45c3bb4c81bdb76a6708575a61a6f25dc7c281bc717c07961894afaa860cda2c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-637","next":"us-ok/okla.-stat.-tit.-82-82-639"},"notice":"GroundRules: Original legal text.
