Stat. tit. 82, § 82-663","heading":"Union of districts - Petition - Notice - Order","body":"In case two or more districts have been organized under this act\n\nin a territory which, in the opinion of the directors of either of\n\nthe districts, should constitute but one district, the board of\n\ndirectors of any one of the districts may petition the court uniting\n\nsaid districts into a single district. Said petition shall be filed\n\nin the office of the court clerk of that county which has the\n\ngreatest valuations of real property, within the districts sought to\n\nbe included, as shown by the tax duplicates of the respective\n\ncounties. Said petition shall set forth the necessity for such\n\nunion of the two or more districts and that the union of said\n\ndistricts would be conducive to the public health, convenience,\n\nsafety or welfare, and to the economical execution of the purpose\n\nfor which the districts were organized. Upon receipt of said\n\npetition the court clerk shall give notice by publication or by\n\npersonal service, to the board of directors of the district or\n\ndistricts which it is desired to unite with the district of the\n\npetitioners. Such notice shall contain the time and place where the\n\nhearing on the petition will be had and the purpose of the same.\n\nSuch hearing shall be had in accordance with the provisions of this\n\nact in original hearing. After the hearing, should the court find\n\nthat the averments of the petition are true and that the said\n\ndistricts, or any of them, should be united it shall so order, and\n\nthereafter proceed as such. The court shall designate the corporate\n\nname of such, as provided for in this act. The court shall direct\n\nin such order who shall be the directors of such united district who\n\nshall thereafter have powers and be subject to such regulations as\n\nare provided for directors in districts created in the first\n\ninstance. All legal proceedings already instituted by or against any\n\nof such constituent districts may be revived and continued against\n\nsuch united districts by an order of court substituting the name of\n\nsuch united district for such constituent district and such\n\nproceedings shall then proceed as herein provided.\n\nInstead of organizing a new district from such constituent\n\ndistricts the court may, in its discretion, direct that one or more\n\nof such districts described in the petition be included into another\n\nof said districts, which order shall continue under its original\n\ncorporate name and organization, or it may direct that the district\n\nor districts so absorbed shall be represented on the board of\n\ndirectors of the original district, designating what members of the\n\nboard of directors of the original district shall be retired from\n\nthe new board and what members take their places; or it may direct\n\nthat the included districts or districts shall become subdistricts\n\nof the main district. In case the districts sought to be united\n\nwere organized in different judicial districts, then the court, to\n\ndetermine the question involved, shall consist of one judge from\n\neach of the judicial districts and a majority shall be necessary to\n\nrender a decision. From such a decision, or from a failure to\n\ndecide, any interested property owner may appeal, as herein\n\nprovided.
