The Grand River Dam Authority, created pursuant to the\n\nprovisions of the Grand River Dam Authority Act, Section 861 et seq.\n\nof this title, is a nonappropriated agency of the State of Oklahoma.\n\nThe Grand River Dam Authority herein referred to as the \"district\"\n\nis subject to the laws of the state as they apply to state agencies\n\nexcept as specifically exempted by statute. All funds generated,\n\nreceived and expended by the district are public funds and subject\n\nto state laws and regulations governing the receipt and expenditure\n\nof public funds in the same manner as all other state agencies\n\nexcept as otherwise provided by statute. The employees of the\n\ndistrict are both classified and unclassified state employees\n\nsubject to the same benefits and restrictions applicable to all\n\nstate agencies except as otherwise provided by statute.\n\nB. Recognizing that the district is a unique agency of this\n\nstate, whose mission requires the ability of the district to\n\nfunction in competition with private industry within the competitive\n\npower market, the Legislature hereby requires the Grand River Dam\n\nAuthority Board of Directors as the rulemaking authority for the\n\ndistrict to:\n\n1. Promulgate appropriate rules governing operations of the\n\ndistrict pursuant to the provisions of Article I of the\n\nAdministrative Procedures Act, with the exception of rules dealing\n\nwith the waters of the Grand River and its tributaries; and\n\n2. Set fees for services performed by the district; provided\n\nthat such fees shall not exceed the cost to the district of\n\nproviding such services;\n\n3. Develop written policies and procedures governing the\n\ndistrict's activities including purchasing, procurement and bidding,\n\npurchase and disposition of real and personal property, fleet\n\nmanagement marketing, consumer education, community relations and\n\ncustomer service functions performed by the district to the extent\n\nit deems necessary; and\n\n4. Develop written hiring and compensation policies of\n\nemployees of the district, subject to the provisions of Section 864\n\nof this title.\n\nC. The district is required to document business expenses\n\nnecessary to carry out the business of the district. Expenses shall\n\nmeet current State of Oklahoma and Internal Revenue Service\n\nguidelines for business expense deductibility.\n\nD. If necessary to comply with the provisions of this act, the\n\nBoard may, by majority vote, employ an independent audit firm to\n\nassist it in its duties. Funds required for this purpose shall be\n\nborne by the district with approval by the Board.\n\nE. The Board of Directors or the management of the district may\n\nseek advice from the State Treasurer or the State Bond Advisor as it\n\ndeems necessary.\n\nF. After the effective date of this act, the district shall not\n\nprovide retail electric power or retail electric service to electric\n\nconsuming facilities except to:\n\n1. An existing electric consuming facility if such electric\n\npower was being provided by the district on the effective date of\n\nAugust 29, 2003; and\n\n2. Any entity located within the boundary of the Oklahoma\n\nOrdnance Works Authority/Mid-America Industrial Park or within a\n\ntwo-mile radius of the boundary.\n\nRetail distribution of electric power shall be defined as any\n\nsale not for resale.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"36e6809ee6cf5d090119104a1987fc5e8875cd627e82bc02aa07b9e4c84e5878","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-861","next":"us-ok/okla.-stat.-tit.-82-82-862"},"notice":"GroundRules: Original legal text.
