Until replaced or changed as provided for in subsection\n\nC of this section, the Grand River Dam Authority is authorized and\n\ndirected to charge an annual use fee of Thirty-five Dollars ($35.00)\n\nper commercially owned and operated flotation device on the Illinois\n\nRiver within Adair, Cherokee and Delaware Counties.\n\n2. The operation of a commercial flotation device without\n\ndisplaying a proper license issued by the Authority shall result in\n\na fine not to exceed One Hundred Dollars ($100.00). The fine shall\n\nbe assessed upon the owner or operator of the commercial flotation\n\ndevice business and not upon the individual renting the commercial\n\nflotation device.\n\n3. Commercial flotation devices shall not be operated on Flint\n\nCreek in Delaware County and those portions of Barren Creek in\n\nCherokee County.\n\nB. For the Flint Creek and Illinois River within Adair,\n\nCherokee and Delaware Counties and those portions of Barren Fork\n\nCreek within Cherokee County, the Authority is authorized and\n\ndirected to charge until replaced or changed as provided for in\n\nsubsection C of this section:\n\n1. An annual use fee of Ten Dollars ($10.00) per noncommercial,\n\nprivately owned device; or\n\n2. A use fee of One Dollar ($1.00) per day for all\n\nnoncommercial, privately owned flotation devices floating upon a\n\ndesignated scenic river. Landowners located immediately adjacent to\n\na designated scenic river shall not be required to pay any fee for\n\nprivate use as authorized in this section or otherwise by law.\n\nC. Under the provisions of Section 896.2 of this title granting\n\nthe Authority the power to establish licenses and set fees, the\n\nAuthority may promulgate rules for the collection and administration\n\nof the fees imposed pursuant to the provisions of this section or\n\nmay promulgate rules establishing licenses, providing for the\n\nissuance, renewal, revocation, denial, and suspension of licenses,\n\nand setting fees that change or replace the licenses and fees\n\nimposed pursuant to the provisions of this section. Upon final\n\nadoption of rules changing or replacing any or all of the licenses\n\nand fees imposed pursuant to the provisions of this section, the\n\nAuthority shall cease to impose, collect or charge the license and\n\nfee that was changed or replaced by rule. Rules promulgated by the\n\nAuthority pursuant to this section shall be in accordance with the\n\nAdministrative Procedures Act.\n\nD. Until replaced or changed as provided for in subsection C of\n\nthis section, the Grand River Dam Authority may charge a fee for use\n\nof camping sites located in public use and access areas controlled\n\nby the Authority in an amount that does not exceed the rate charged\n\nby the Oklahoma Tourism and Recreation Department for camping sites.\n\nE. For the purposes of the Scenic Rivers Act, \"commercial\n\nflotation device\" means a canoe, boat, kayak, inner tube, raft or\n\nother similar device suitable for the transportation of a person or\n\npersons on waterways which is available for hire by the public for\n\nuse on scenic rivers.","path":["OK Code","Title 82"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os82.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9f9f50e7857da6edb2e19b421f438b045d138dede4181307bf03eec9e1d5ddc2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-82-82-896.15","next":"us-ok/okla.-stat.-tit.-82-82-896.2"},"notice":"GroundRules: Original legal text.
