The term \"scenic river\" as used in the Scenic Rivers Act is\n\ndefined as a stream or river designated pursuant to Section 896.5 of\n\nthis title and the public use and access areas located within or\n\nadjacent to the stream or river.\n\nB. It is the intent of the Legislature that a stream or river\n\ndesignated as a scenic river shall be preserved in its free-flowing\n\ncondition and shall not be impounded by any large dam or structure\n\nexcept as specifically authorized by the Legislature.\n\nC. No agency or official of state government shall authorize or\n\nconcur in plans of local, state or federal agencies for the\n\nconstruction, operation, or maintenance of any dam or related\n\nproject in or adjacent to any scenic river without legislative\n\nconsent, except as needed by the municipalities located in the\n\ncounties or the immediate vicinity of the scenic river for their own\n\nmunicipal or domestic water supply if such uses and structures will\n\nnot significantly interfere with the preservation of the stream as a\n\nscenic free-flowing stream.\n\nD. It is recognized by the Legislature that an effective\n\nprogram for preserving the scenic beauty of the free-flowing streams\n\nand rivers designated as a scenic river area necessarily involves\n\nthe cooperation and support of the people in the operating areas of\n\na designated scenic river, as well as the people using the scenic\n\nriver, and the agencies of state government administering these\n\nareas.\n\nE.
