Stat. tit. 84, § 84-1","heading":"Legacies classed","body":"Legacies are distinguished and designated, according to their\n\nnature, as follows:\n\n1. A legacy of a particular thing, specified and distinguished\n\nfrom all others of the same kind belonging to the testator is\n\nspecific; if such legacy fails, resort cannot be had to the other\n\nproperty of the testator.\n\n2. A legacy is demonstrative when the particular fund or\n\npersonal property is pointed out from which it is to be taken or\n\npaid; if such fund or property fails in whole or in part, resort may\n\nbe had to the general assets as in case of a general legacy.\n\n3. An annuity is a bequest of certain specified sums\n\nperiodically; if the fund or property out of which they are payable\n\nfails, resort may be had to the general assets, as in case of a\n\ngeneral legacy.\n\n4. A residuary legacy embraces only that which remains after\n\nall the bequests of the will are discharged.\n\n5. All other legacies are general legacies.
