Stat. tit. 84, § 84-257","heading":"Actions to determine persons entitled to real property -","body":"Description of parties - Publication of notice.\n\nWhere any person dies intestate possessed of real property in\n\nthis state, or dies having devised pursuant to the law of this state\n\nany real property in this state, in terms to \"heirs,\" \"relations,\"\n\n\"nearest relations,\" \"representatives,\" \"legal representatives,\"\n\n\"personal representatives,\" \"family,\" \"issues,\" \"descendants,\"\n\n\"nearest of kin,\" or to persons by any other description or\n\ndesignation which leaves at large the names or individual identity\n\nof the particular person embraced therein, and the period of one (1)\n\nor more years since the death of such intestate or testator has\n\nelapsed without their having been a decree by the district court of\n\nthe county having jurisdiction to administer upon his estate,\n\nwherein it was judicially determined who, by name, are or were all\n\nthe particular persons entitled to participate in the distribution\n\nof such real property under such devise or the law of succession, or\n\nwhere the grantees in any deed, or deed of patent made and issued or\n\ndesignated as \"the devisees,\" of \"the heirs at law\" or \"the legal\n\nrepresentatives\" of a named deceased person, without naming them, or\n\nby any other description or designation which leaves at large the\n\nnames or individual identity of the particular persons embraced\n\ntherein, the name and individual identity of each and all the\n\npersons who take or were entitled to take such real property and the\n\nproportion or part thereof which each takes or was entitled to take,\n\nimmediately under such testamentary devise, or grant, or the law of\n\nsuccession, may be judicially determined and jurisdiction thereto\n\ninvoked in the manner following: In any action which relates to or\n\nthe subject matter of which is such real property, or for the\n\ndetermination in any form of any interest, right, title or estate\n\ntherein, or in which the relief demanded consists wholly or partly\n\nin excluding the defendants or any of them from any interest, right,\n\ntitle or estate therein, the plaintiff may allege, among other\n\nthings, in his petition, the facts showing such testamentary devise,\n\nor grant of, or intestate succession to, such real property, and\n\n(regardless of whether they or any of them be living or dead) the\n\nnames as he is informed and believes, all of the devisees, or\n\ngrantees, or heirs at law, as the case may be, who take or were\n\nentitled to take such real property and the proportion or part which\n\neach takes or was entitled to take therein, immediately under such\n\ndevise, or grant, or intestate succession; and he may make all such\n\ndevisees, or grantees, or heirs at law, their heirs, executors,\n\nadministrators, devisees, trustees and assigns, parties defendant in\n\nsuch action under the description, and have service of notice by\n\npublication upon them under such description, to-wit: \"The heirs,\n\nexecutors, administrators, devisees, trustees and assigns, of\n\n__________ deceased.\" (Naming such testator, or intestate, or the\n\nperson stated in such deed or patent to be deceased, as the case may\n\nbe.","path":["OK Code","Title 84"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os84.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"15bb8e0c5bb8e439eb61c35e25db84eff144d125f8592fb95fafb60f4a6c2b87","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-84-84-256","next":"us-ok/okla.-stat.-tit.-84-84-258"},"notice":"GroundRules: Original legal text.
