Stat. tit. 84, § 84-260","heading":"Service by publication - Mailing notice to persons named","body":"in petition.\n\nWhen such petition is filed, the party may proceed to make\n\nservice by publication upon such defendants, in the manner\n\nfollowing: The publication notice must, in such case, be addressed\n\nin terms, to \"the heirs, executors, administrators, devisees,\n\ntrustees and assigns, of __________ deceased\" (naming such deceased\n\nperson). It shall be issued over the official signature of the clerk\n\nof the court; shall state the court in which the petition is filed,\n\nthe name of the plaintiff, the above description of such defendants,\n\nand must notify the defendants thus described that they have been\n\nsued and must answer the petition filed by the plaintiff, on or\n\nbefore a time to be stated (which shall not be less than forty-one\n\n(41) days from the date of the first publication), or the petition\n\nwill be taken as true, and judgment, the nature of which shall be\n\nstated, will be rendered accordingly. The publication must be made\n\nthree (3) consecutive weeks in some newspaper authorized by law to\n\npublish notices in legal proceedings, printed in the county where\n\nthe petition is filed, if there be any printed in such county, and\n\nif there be not, then in some newspaper printed in this state of\n\ngeneral circulation in that county.
