Stat. tit. 84, § 84-271","heading":"Conditions of escheat","body":"Subject to the provisions of Sections 271.1 through 277 of this\n\ntitle, the estate or property of any person shall escheat to and\n\nvest in the state if:\n\n1. Such person die seized of any real property, including\n\nminerals or mineral interests, or possessed of any personal estate,\n\nwithout any devise thereof, and having no heirs; or\n\n2. Such person is the owner of any real or personal estate\n\n(except mineral interests subject to sale under Section 271.1 of\n\nthis title), and shall be absent for the term of seven (7) years,\n\nand is not known to exist. Provided, that where no will is recorded\n\nor probated in the county where such property is situate within\n\nseven (7) years after the death of such owner, it shall be prima\n\nfacie evidence that there was no will, and where no lawful claim is\n\nasserted to, or lawful acts of ownership exercised in such property\n\nfor the period of seven (7) years, and this has been proved to the\n\nsatisfaction of the court, it shall be deemed prima facie evidence\n\nof the death of the owner and of the failure of heirs; and the court\n\ntrying the cause, may, if such evidence is not rebutted, find\n\ntherefrom in favor of the state; provided, further, that the state\n\nmay, without waiting the limit of seven (7) years, bring proceedings\n\nand escheat any such property by making proof of the death of the\n\nowner and the failure of heirs, and nonexistence of will.","path":["OK Code","Title 84"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os84.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"08a09e148587f8ebebcfceb8392340b5f25df4ee228476866e67c7cd5c692b4f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-84-84-27","next":"us-ok/okla.-stat.-tit.-84-84-271.1"},"notice":"GroundRules: Original legal text.
