The right to any claim, benefit or compensation shall not be\n\nreleased or commuted except as provided by the Administrative\n\nWorkers' Compensation Act and, except for child support liens, is\n\nnot assignable and is not subject to garnishment, attachment, levy,\n\nexecution, or any other legal process. Monetary compensation to\n\ndependents of a deceased employee shall not constitute assets of the\n\nestate of the deceased employee and shall be payable to and for the\n\nbenefit of the dependents alone. Any amount withheld under the\n\nprovisions of this section shall be treated as if it were paid to\n\nthe employee as workers' compensation and paid by the employee to\n\nthe person or agency to whom the obligation is payable.\n\nB. A lien against workers' compensation benefits is authorized\n\nfor the purpose of enforcing a judgment for child support. Child\n\nsupport liens filed in accordance with Section 135 of Title 43 of\n\nthe Oklahoma Statutes are specifically authorized and shall be paid\n\nin accordance with such statute without any order of the Commission.\n\nC. Additionally, all income assignments or wage assignments for\n\nchild support issued pursuant to Section 1170 of Title 12 of the\n\nOklahoma Statutes or Section 237.7 of Title 56 of the Oklahoma\n\nStatutes are specifically authorized and shall be paid in accordance\n\nwith such statutes without any order of the Commission.\n\nD. In the event a child support lien is filed in a case before\n\nthe Commission, an administrative law judge of the Commission shall\n\nrecognize such lien in any award of monetary benefits and the\n\nemployer or insurance carrier shall include the name of the person\n\nor government agency asserting the lien on any check for temporary\n\ntotal disability, permanent partial disability or permanent and\n\ntotal disability.","path":["OK Code","Title 85A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os85A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"adec444d3a05cb4b7291ddf65fa773bb6ec674b77fc909c81a33888aadfe0c52","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-85a-85a-1","next":"us-ok/okla.-stat.-tit.-85a-85a-100"},"notice":"GroundRules: Original legal text.
