Stat. tit. 85A, § 85A-105","heading":"Compensation Commission and Self-insurance Guaranty Fund","body":"employees as witnesses - Solicitation of employment - Ex-parte\n\ncommunication.\n\nA. No employee of the Workers' Compensation Commission shall be\n\ncompetent to testify on any matter concerning any information the\n\nemployee has received through the performance of the employee's\n\nduties under the provisions of the Administrative Workers'\n\nCompensation Act; provided, however, such provision shall not be\n\nconstrued to prohibit testimony by an attorney of the Compliance\n\nDivision of the Commission or an investigator of the Division called\n\nto provide testimony by the attorney.\n\nB. The commissioners and employees of the Commission shall not\n\nsolicit employment for any attorney or physician nor shall they\n\nrecommend or refer any claimant or employer to an attorney or\n\nphysician. If any employee of the Commission makes such a\n\nsolicitation, recommendation or reference, that person, upon\n\nconviction, shall be guilty of a misdemeanor punishable, for each\n\noffense, by a fine of not more than One Thousand Dollars ($1,000.00)\n\nor by imprisonment in the county jail not to exceed one (1) year, or\n\nby both such fine and imprisonment. The Commission shall\n\nimmediately terminate the employment of any employee who is guilty\n\nof such solicitation, recommendation or reference. A commissioner\n\nguilty of such solicitation, recommendation or reference shall be\n\nsubject to removal from office.\n\nC. No administrative law judge shall engage in any ex parte\n\ncommunication with any party to an action pending before the\n\nCommission or with any witness or medical provider regarding the\n\nmerits of a specific matter pending before the judge for resolution.\n\nAny violation of this provision shall subject the judge to\n\ndisqualification from the action or matter upon presentation of an\n\napplication for disqualification.","path":["OK Code","Title 85A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os85A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3c1e21152c8063be98b1b74329a20db2418e2b6a7a86bc0a2899a8ab159a8477","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-85a-85a-104","next":"us-ok/okla.-stat.-tit.-85a-85a-106"},"notice":"GroundRules: Original legal text.
