The Workers' Compensation Commission shall establish a\n\nworkers' compensation counselor or ombudsman program to assist\n\ninjured workers, employers and persons claiming death benefits in\n\nobtaining benefits under this act. A special effort shall be made\n\nto equip counselors or ombudsmen with sufficient resources to assist\n\ninjured workers through the system without the necessity of\n\nretaining legal representation.\n\nB. Workers' compensation counselors or ombudsmen shall provide\n\ninformation to injured workers; investigate complaints; communicate\n\nwith employers, insurance carriers, self-insurers, and health care\n\nproviders; provide informational seminars and workshops on workers'\n\ncompensation for medical providers, insurance adjustors, and\n\nemployee and employer groups; and develop informational materials\n\nfor employees, employers and medical providers.\n\nC. The Commission shall mail a notice to the injured worker\n\nwithin ten (10) days of the filing of an Employer’s First Notice of\n\nInjury. The notice shall advise the injured worker of the\n\navailability of the services of the Commission's counselor or\n\nombudsman program and of the availability of mediation and other\n\nforms of alternative dispute resolution to assist the injured\n\nworker. The Commission shall provide additional information as the\n\nCommission may determine necessary.\n\nD. The Commission shall develop a program that provides for\n\nannual training for own-risk employers and claims representatives\n\nhandling workers’ compensation claims in Oklahoma.
