Except as otherwise provided by state or federal law and\n\nsubject to the provisions of this section, an employer may inquire\n\nabout previous workers' compensation claims paid to an employee\n\nwhile the employee was employed by a previous employer. If the\n\nemployee fails to answer truthfully about any previous permanent\n\npartial disability awards made pursuant to workers' compensation\n\nclaims, the employee shall be subject to discharge by the employer.\n\nB. 1. All requests made to the Workers' Compensation\n\nCommission for information on workers' compensation claims involving\n\na worker, including written inquiries about prior claims and\n\nrequests to access a worker's compensation claim file, must be in\n\nwriting, on a form prescribed by the Commission, and accompanied by\n\na fee of One Dollar ($1.00) per search request, not to exceed One\n\nDollar ($1.00) per claims record of a particular worker. The fee\n\nshall be deposited to the credit of the Workers' Compensation\n\nCommission Revolving Fund. The form shall require identification of\n\nthe person requesting the information, and the person for whom a\n\nsearch is being made if different from the requester. The form must\n\ncontain an affidavit signed by the requester under penalty of\n\nperjury that the information sought is not requested for a purpose\n\nin violation of state or federal law. The form must be used by all\n\nrepositories of archived Court claim files. All request forms shall\n\nbe maintained by the Commission as a public record, together with a\n\nrecord of a worker's written authorization permitting a search\n\nindexed by the worker's Social Security number as required by\n\nSection 3113 of Title 74 of the Oklahoma Statutes. The request\n\nforms and authorizations shall be indexed alphabetically by the last\n\nname of the worker.\n\n2. This subsection shall not apply:\n\na. to requests for claims information made by a public\n\nofficer or by a public employee in the performance of\n\nhis or her duties on behalf of a governmental entity\n\nor as may be allowed by law,\n\nb. to requests for claims information made by an insurer,\n\nself-insured employer, third-party claims\n\nadministrator, or a legal representative thereof, when\n\nnecessary to process or defend a workers' compensation\n\nclaim,\n\nc. when a worker or the worker's representative requests\n\nreview of the worker's claims information,\n\nd. when the disclosure is made for educational or\n\nresearch purposes and in such a manner that the\n\ndisclosed information cannot be used to identify any\n\nworker who is the subject of a claim,\n\ne. to requests for claims information made by a health\n\ncare or rehabilitation provider or the provider's\n\nlegal representative when necessary to process payment\n\nof health care or rehabilitation services rendered to\n\na worker, and\n\nf. to requests for claims information made by an employer\n\nor personnel service company, including but not\n\nlimited to an individual or entity, where the worker\n\nexecutes a written authorization permitting the search\n\nand designating the employer or personnel service\n\ncompany as the worker's representative for that\n\npurpose; however, nothing in this subparagraph shall\n\nrelieve the employer or personnel service company from\n\ncomplying with the requirements of utilizing the form\n\nset forth in paragraph 1 of this subsection.","path":["OK Code","Title 85A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os85A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f543b77eefc32bd10a128b3c09fb858f74d28afd5ee47da03a6728f97b505794","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-85a-85a-12","next":"us-ok/okla.-stat.-tit.-85a-85a-121"},"notice":"GroundRules: Original legal text.
