On application and motion of a person showing an agreement\n\nto arbitrate and alleging another person's refusal to arbitrate\n\nunder the agreement:\n\n1. If the refusing party does not appear or does not oppose the\n\nmotion, the Workers' Compensation Commission shall order the parties\n\nto arbitrate; and\n\n2. If the refusing party opposes the motion, the Commission\n\nshall proceed summarily to decide the issue and order the parties to\n\narbitrate unless it finds that there is no enforceable agreement to\n\narbitrate. The Commission may also assess costs against the party\n\nopposing the motion if it concludes the opposition was not brought\n\nin good faith to be deposited in the Workers' Compensation\n\nCommission Revolving Fund created in Section 28.1 of this title.\n\nB. On motion of a person alleging that an arbitration\n\nproceeding has been initiated or threatened but that there is no\n\nagreement to arbitrate, the Commission shall proceed summarily to\n\ndecide the issue. If the Commission finds that there is an\n\nenforceable agreement to arbitrate, it shall order the parties to\n\narbitrate. The Commission may also assess costs against the party\n\nopposing the motion if the Commission concludes the opposition was\n\nnot brought in good faith to be deposited in the Workers'\n\nCompensation Fund created by the Administrative Workers'\n\nCompensation Act.\n\nC. If the Commission finds that the parties have not entered\n\ninto an enforceable arbitration agreement, the dispute shall be\n\nresolved under the Administrative Workers' Compensation Act.\n\nD. If an action is initiated in district court to determine\n\nwhether an enforceable arbitration agreement exists, on motion by\n\nthe responding party, that proceeding shall be transferred to the\n\nCommission for determination.\n\nE.
