Within ten (10) days after the date of receipt of notice or\n\nof knowledge of injury or death, the employer shall send to the\n\nWorkers' Compensation Commission a report setting forth:\n\n1. The name, address, and business of the employer;\n\n2. The name, address, and occupation of the employee;\n\n3. The cause and nature of the injury or death;\n\n4. The year, month, day, approximately when, and the particular\n\nlocality where, the injury or death occurred; and\n\n5. Such other information as the Commission may require.\n\nB. Additional reports with respect to the injury and of the\n\ncondition of the employee shall be sent by the employer to the\n\nCommission at such time and in such manner as the Commission may\n\nprescribe. However, an employer may refuse to provide any\n\ninformation that it deems privileged or confidential.\n\nC. Any report provided for in subsection A or B of this section\n\nshall not be evidence of any fact stated in the report in any\n\nproceeding with respect to the injury or death on account of which\n\nthe report is made. Any such report shall be kept confidential and\n\nshall not be open to public inspection; provided, however, such\n\nreport shall be made available immediately upon request by the\n\ninjured employee named in the report, the injured employee's legal\n\nrepresentative, or any prosecutorial authority. The report shall be\n\nopen to public inspection upon the employee's first notice of claim\n\nfor compensation being filed.\n\nD. The mailing of any report in a stamped envelope, properly\n\naddressed, within the time prescribed in subsection A or B of this\n\nsection, shall be in compliance with this section. In addition, the\n\nCommission shall establish a means of electronic delivery of any\n\nreport or other information required by this section.\n\nE. 1. Any employer who after notice refuses to send any report\n\nrequired by this section shall be subject to a civil penalty in an\n\namount of Five Hundred Dollars ($500.00) for each refusal.\n\n2. Whenever the employer has failed or refused to comply as\n\nprovided in this section, the Commission may serve on the employer a\n\nproposed judgment declaring the employer to be in violation of this\n\nact and containing the amount, if any, of the civil penalty to be\n\nassessed against the employer under this section.\n\nF. An employer may contest a proposed judgment of the\n\nCommission issued under subsection E of this section by filing with\n\nthe Commission, within twenty (20) days of receipt of the proposed\n\njudgment, a written request for a hearing. If a written request for\n\nhearing is not filed with the Commission within this time, the\n\nproposed judgment, proposed penalty, or both, shall be a final\n\njudgment of the Commission. The request for a hearing does not need\n\nto be in any particular form but shall specify the grounds on which\n\nthe person contests the proposed judgment, the proposed assessment,\n\nor both. A proposed judgment by the Commission under this section\n\nshall be prima facie correct, and the burden is on the employer to\n\nprove that the proposed judgment is incorrect.\n\nG. Hearings conducted under this section shall proceed as\n\nprovided in Sections 69 through 78 of this title.\n\nH. If an employer fails to pay any civil penalty assessed\n\nagainst the employer after a judgment issued under this section has\n\nbecome final by operation of law, the Commission may petition the\n\ndistrict court of the county where the employer's principal place of\n\nbusiness is located for an order enjoining the employer from\n\nengaging in further employment or conduct of business until such\n\ntime as the employer makes all required reports and pays all civil\n\npenalties.","path":["OK Code","Title 85A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os85A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2ac576901dc02bec7dd83cfc109e0a0ecf6f7a0027050460dd585da1200c591a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-85a-85a-62","next":"us-ok/okla.-stat.-tit.-85a-85a-64"},"notice":"GroundRules: Original legal text.
