Any party feeling aggrieved by the judgment, decision, or\n\naward made by the administrative law judge may, within ten (10) days\n\nof issuance, appeal to the Workers' Compensation Commission. After\n\nhearing arguments, the Commission may reverse or modify the decision\n\nonly if it determines that the decision was against the clear weight\n\nof the evidence or contrary to law. All such proceedings of the\n\nCommission shall be recorded by a court reporter, if requested by\n\nany party. Any judgment of the Commission which reverses a decision\n\nof the administrative law judge shall contain specific findings\n\nrelating to the reversal.\n\nB. The appellant shall pay a filing fee of One Hundred Seventy-\n\nfive Dollars ($175.00) to the Commission at the time of filing his\n\nor her appeal. The fee shall be deposited to the credit of the\n\nWorkers' Compensation Commission Revolving Fund.\n\nC. The judgment, decision or award of the Commission shall be\n\nfinal and conclusive on all questions within its jurisdiction\n\nbetween the parties unless an action is commenced in the Supreme\n\nCourt of this state to review the judgment, decision or award within\n\ntwenty (20) days of being sent to the parties. Any judgment,\n\ndecision or award made by an administrative law judge shall be\n\nstayed until all appeal rights have been waived or exhausted. The\n\nSupreme Court may modify, reverse, remand for rehearing, or set\n\naside the judgment or award only if it was:\n\n1. In violation of constitutional provisions;\n\n2. In excess of the statutory authority or jurisdiction of the\n\nCommission;\n\n3. Made on unlawful procedure;\n\n4. Affected by other error of law;\n\n5. Clearly erroneous in view of the reliable, material,\n\nprobative and substantial competent evidence;\n\n6. Arbitrary or capricious;\n\n7. Procured by fraud; or\n\n8. Missing findings of fact on issues essential to the\n\ndecision.\n\nThis action shall be commenced by filing with the Clerk of the\n\nSupreme Court a certified copy of the judgment, decision or award of\n\nthe Commission attached to the petition by the complaint which shall\n\nspecify why the judgment, decision or award is erroneous or illegal.\n\nThe proceedings shall be heard in a summary manner and shall have\n\nprecedence over all other civil cases in the Supreme Court, except\n\npreferred Corporation Commission appeals. The Supreme Court shall\n\nrequire the appealing party to file within forty-five (45) days from\n\nthe date of the filing of an appeal or a judgment appealed from, a\n\ntranscript of the record of the proceedings before the Commission,\n\nor such later time as may be granted by the Supreme Court on\n\napplication and for good cause shown. The action shall be subject\n\nto the law and practice applicable to other civil actions cognizable\n\nin the Supreme Court.\n\nD. A fee of One Hundred Dollars ($100.00) per appeal to the\n\nSupreme Court shall be paid to the Commission and deposited to the\n\ncredit of the Workers' Compensation Commission Revolving Fund as\n\ncosts for preparing, assembling, indexing and transmitting the\n\nrecord for appellate review. This fee shall be paid by the party\n\ntaking the appeal.
