Each employer desiring to controvert an employee's right\n\nto compensation may file with the Workers' Compensation Commission\n\non or before the fifteenth day following notice of the alleged\n\ninjury or death a statement on a form prescribed by the Commission\n\nthat the right to compensation is controverted and the grounds for\n\nthe controversion, the names of the claimant, employer, and carrier,\n\nif any, and the date and place of the alleged injury or death.\n\n2. Failure to file the statement of controversion shall not\n\npreclude the employer's ability to controvert the claim or cause it\n\nto waive any defenses. The employer can make additional defenses\n\nnot included in the initial notice at any time.\n\nB. If an employer is unable to obtain sufficient medical\n\ninformation as to the alleged injury or death within fifteen (15)\n\ndays following receipt of notice, although the employer has acted in\n\ngood faith and with all due diligence, the employer may apply in\n\nwriting for an extension of time for making payment of the first\n\ninstallment or controverting the claim. This written application is\n\nto be postmarked within the fifteen-day period. The Commission may,\n\nin its discretion, grant the extension and fix the additional time\n\nto be allowed. Filing of application for an extension shall not be\n\ndeemed to be a controversion of the claim.\n\nC.
