The Self-insurance Guaranty Fund shall be administered,\n\nsupervised and protected by the Self-insurance Guaranty Fund Board.\n\nAll self-insurers under the Administrative Workers' Compensation Act\n\nshall participate in the fund as a condition of authority to self-\n\ninsure in this state, except public employers that self-insure\n\npursuant to Section 107 of this title.\n\nB. 1. The Self-insurance Guaranty Fund Board shall consist of\n\nfive (5) members to be appointed as follows:\n\na. the Governor shall appoint two members, one of whom\n\nshall represent an approved group self-insurance\n\nassociation authorized to self-insure pursuant to\n\nSection 38 or Section 102 of this title,\n\nb. the President Pro Tempore of the Senate shall appoint\n\none member who shall be an attorney licensed in this\n\nstate who is engaged in the primary practice of\n\nworkers' compensation law,\n\nc. the Speaker of the House of Representatives shall\n\nappoint one member who represents a private self-\n\ninsurer, and\n\nd. the Chair of the Oklahoma Workers' Compensation\n\nCommission shall appoint one member who shall be a\n\nlicensed claims adjuster affiliated with either a\n\nprivate self-insurer or an approved group self-\n\ninsurance association.\n\n2. Members of the Workers' Compensation Self-insurance Guaranty\n\nFund Board serving on January 31, 2014, shall constitute the initial\n\nappointees to the Self-insurance Guaranty Fund Board created\n\npursuant to this section, with terms extended an additional two (2)\n\nyears beyond their original, respective expiration dates.\n\n3. In the event of a vacancy, the appointing authority for the\n\nposition shall appoint a qualified successor to serve as the\n\nappointee for the unexpired term of the member so replaced. The\n\nterm of office for the appointees shall be as follows:\n\na. the term of office for three positions, one each\n\nappointed by the Governor, President Pro Tempore of\n\nthe Senate and Speaker of the House of\n\nRepresentatives, shall expire on November 1, 2016, and\n\nb. the term of office for two positions, one each\n\nappointed by the Governor and the Chair of the\n\nCommission, shall expire on November 1, 2015.\n\nThereafter, successor members shall be appointed for a three-\n\nyear term. Members may serve successive terms. Any person\n\nappointed to fill a vacancy shall be appointed for the unexpired\n\nportion of the term in the same manner as the original appointment.\n\n4. The chair and vice-chair of the Board shall be elected by\n\nthe Board from among its members.\n\n5. Members of the Board shall not receive compensation for\n\nserving on the Board but shall be reimbursed from monies in the fund\n\nfor their necessary travel expenses incurred in the performance of\n\ntheir duties in accordance with the State Travel Reimbursement Act.\n\nC. Meetings of the Board shall be held at least quarterly. The\n\npresence of a majority of the members constitutes a quorum. No\n\naction shall be taken by the Board without the affirmative vote of\n\nat least a majority of the members.\n\nD. The Office of the Attorney General shall provide legal\n\ncounsel to assist the Board in the performance of its duties.\n\nE. No member or personnel of the Self-insurance Guaranty Fund\n\nBoard, the Workers' Compensation commissioners or any employee of\n\nthe Workers' Compensation Commission shall be liable in a civil\n\nproceeding for any act performed in good faith in the execution of\n\nthat person's powers or duties pursuant to Sections 96 through 100\n\nof the Administrative Workers' Compensation Act.","path":["OK Code","Title 85A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os85A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2cc738898c43465339bdc5650c2139628a4903070af384bba3fb02dd9f1ecf02","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-85a-85a-95","next":"us-ok/okla.-stat.-tit.-85a-85a-97"},"notice":"GroundRules: Original legal text.
