On determination by the Workers' Compensation Commission\n\nthat a self-insurer has become an impaired self-insurer, the\n\nCommission shall secure release of the security required by Section\n\n38 of this title and advise the Self-insurance Guaranty Fund Board\n\nof the impairment. Claims administration, including processing,\n\ninvestigating and paying valid claims against an impaired self-\n\ninsurer under the Administrative Workers' Compensation Act, may\n\ninclude payment by the surety that issued the surety bond or be\n\nunder a contract between the Commission and an insurance carrier,\n\nappropriate state governmental entity or an approved service\n\norganization, as approved by the Commission.\n\nB. Excess proceeds from the security remaining after each claim\n\nfor benefits of an impaired self-insurer has been paid, settled or\n\nlapsed, and associated costs of administration of such claim have\n\nbeen paid, shall be transferred to the Self-insurance Guaranty Fund\n\nand may be used as a credit against the assessment required to be\n\npaid by each private self-insurer and group self-insurer association\n\npursuant to Section 98 of this title, as determined by the Self-\n\ninsurance Guaranty Fund Board.","path":["OK Code","Title 85A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os85A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c6ffa62fc04212425319a238728b41d12ac69ab906cbd236e4345fd656641895","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-85a-85a-98","next":"us-ok/okla.-stat.-tit.-85-85-134"},"notice":"GroundRules: Original legal text.
