{"data":{"id":"us-pa/13-pa.c.s.-7309","jurisdiction":"us-pa","citation":"13 Pa.C.S. § 7309","heading":"Duty of care; contractual limitation of carrier's liability.","body":"(a) Standard.--A carrier that issues a bill of lading, whether negotiable or nonnegotiable, shall exercise the degree of care in relation to the goods which a reasonably careful person would exercise under similar circumstances. This subsection shall not affect any statute, regulation or rule of law that imposes liability upon a common carrier for damages not caused by its negligence.\n(b) Limitation of damages.--\n(1) Except as set forth in paragraph (2), damages may be limited by a term in the bill of lading or in a transportation agreement that the carrier's liability may not exceed a value stated in the bill or transportation agreement if the carrier's rates are dependent upon value and the consignor is afforded an opportunity to declare a higher value and the consignor is advised of the opportunity.\n(2) A limitation under paragraph (1) is not effective with respect to the carrier's liability for conversion to its own use.\n(c) Included provisions.--Reasonable provisions as to the time and manner of presenting claims and commencing actions based on the shipment may be included in a bill of lading or a transportation agreement.","path":["Title 13 - COMMERCIAL CODE","CHAPTER 73 BILLS OF LADING: SPECIAL PROVISIONS"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=13\u0026div=0\u0026chpt=73\u0026sctn=9\u0026subsctn=0","current_through":"2025-12-01 (Statute Update stamp, 13 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:31:03Z","sha256":"f734aa0f7074cde43eb04eeaf3ea057393a7b6df6b6d80214b0dce549af9ffb0","source_id":"us-pa","stale":false,"prev":"us-pa/13-pa.c.s.-7308","next":"us-pa/13-pa.c.s.-7401"},"notice":"GroundRules: Original legal text.
