{"data":{"id":"us-pa/18-pa.c.s.-3104","jurisdiction":"us-pa","citation":"18 Pa.C.S. § 3104","heading":"Evidence of victim's sexual conduct.","body":"(a) General rule.--Evidence of specific instances of the alleged victim's past sexual conduct, past sexual victimization, allegations of past sexual victimization, opinion evidence of the alleged victim's past sexual conduct, and reputation evidence of the alleged victim's past sexual conduct shall not be admissible in prosecutions of any offense listed in subsection (c) except evidence of the alleged victim's past sexual conduct with the defendant where consent of the alleged victim is at issue and such evidence is otherwise admissible pursuant to the rules of evidence.\n(b) Evidentiary proceedings.--A defendant who proposes to offer evidence of the alleged victim's past sexual conduct, past sexual victimization, allegations of past sexual victimization, opinion evidence of the alleged victim's past sexual conduct and reputation evidence of the alleged victim's past sexual conduct pursuant to subsection (a) shall file a written motion and offer of proof at the time of trial. If, at the time of trial, the court determines that the motion and offer of proof are sufficient on their faces, the court shall order an in camera hearing and shall make findings on the record as to the relevance and admissibility of the proposed evidence pursuant to the standards set forth in subsection (a).\n(c) Applicability.--This section shall apply to prosecutions of any of the following offenses, including conspiracy, attempt or solicitation to commit any of the following offenses, enumerated in this title:\nChapter 27 (relating to assault).\nChapter 29 (relating to kidnapping).\nChapter 30 (relating to human trafficking).\nChapter 31 (relating to sexual offenses).\nSection 4302 (relating to incest).\nSection 4304 (relating to endangering welfare of children), if the offense involved sexual contact with the victim.\nSection 6301(a)(1)(ii) (relating to corruption of minors).\nSection 6312(b) (relating to sexual abuse of children).\nSection 6318 (relating to unlawful contact with minor).\nSection 6320 (relating to sexual exploitation of children).","path":["Title 18 - CRIMES AND OFFENSES","PART II DEFINITION OF SPECIFIC OFFENSES","ARTICLE B OFFENSES INVOLVING DANGER TO THE PERSON","CHAPTER 31 SEXUAL OFFENSES","SUBCHAPTER A GENERAL PROVISIONS"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=18\u0026div=0\u0026chpt=31\u0026sctn=4\u0026subsctn=0","current_through":"2026-08-31 (Statute Update stamp, 18 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:31:28Z","sha256":"118512be0f327d0275b935e134b28c83c9be7089486daed925ea16a5ad50214a","source_id":"us-pa","stale":false,"prev":"us-pa/18-pa.c.s.-3103","next":"us-pa/18-pa.c.s.-3105"},"notice":"GroundRules: Original legal text.
