{"data":{"id":"us-pa/23-pa.c.s.-77a04","jurisdiction":"us-pa","citation":"23 Pa.C.S. § 77A04","heading":"Initiation by department of support proceeding under convention.","body":"(a) Duties.--In a support proceeding under this chapter, the department shall do all of the following:\n(1) Transmit and receive applications.\n(2) Initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this State.\n(b) Obligee support proceedings.--All of the following support proceedings are available to an obligee under the convention:\n(1) Recognition or recognition and enforcement of a foreign support order.\n(2) Enforcement of a support order issued or recognized in this State.\n(3) Establishment of a support order if there is no existing order, including, if necessary, determination of parentage of a child.\n(4) Establishment of a support order if recognition of a foreign support order is refused under section 77A08(b)(2), (4) or (9) (relating to recognition and enforcement of registered convention support order).\n(5) Modification of a support order of a tribunal of this State.\n(6) Modification of a support order of a tribunal of another state or a foreign country.\n(c) Obligor support proceedings.--All of the following support proceedings are available under the convention to an obligor against which there is an existing support order:\n(1) Recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this State.\n(2) Modification of a support order of a tribunal of this State.\n(3) Modification of a support order of a tribunal of another state or a foreign country.\n(d) Prohibition.--A tribunal of this State may not require security, bond or deposit, however described, to guarantee the payment of costs and expenses in proceedings under the convention.","path":["Title 23 - DOMESTIC RELATIONS","PART VIII UNIFORM INTERSTATE FAMILY SUPPORT","CHAPTER 77A SUPPORT PROCEEDING UNDER CONVENTION"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=23\u0026div=0\u0026chpt=0\u0026sctn=0\u0026subsctn=0","current_through":"2026-07-29 (Statute Update stamp, 23 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:31:43Z","sha256":"788463d0b20051c15d4bbdc71b9ac0b884b3bf698388a203899a3800026fac33","source_id":"us-pa","stale":false,"prev":"us-pa/23-pa.c.s.-77a03","next":"us-pa/23-pa.c.s.-77a05"},"notice":"GroundRules: Original legal text.
