{"data":{"id":"us-pa/3-pa.c.s.-312","jurisdiction":"us-pa","citation":"3 Pa.C.S. § 312","heading":"Definitions.","body":"The following words and phrases when used in this chapter shall have the meanings given to them in this section unless the context clearly indicates otherwise:\n\"Local government unit.\" A political subdivision of the Commonwealth.\n\"Normal agricultural operation.\" As defined under section 2 of the act of June 10, 1982 (P.L.454, No.133), entitled \"An act protecting agricultural operations from nuisance suits and ordinances under certain circumstances.\"\n\"Unauthorized local ordinance.\" An ordinance enacted or enforced by a local government unit which does any of the following:\n(1) Prohibits or limits a normal agricultural operation unless the local government unit:\n(i) has expressed or implied authority under State law to adopt the ordinance; and\n(ii) is not prohibited or preempted under State law from adopting the ordinance.\n(2) Restricts or limits the ownership structure of a normal agricultural operation.","path":["Title 3 - AGRICULTURE","PART I GENERAL PROVISIONS","CHAPTER 3 LOCAL REGULATION","SUBCHAPTER A PRELIMINARY PROVISIONS"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=03\u0026div=0\u0026chpt=3\u0026sctn=12\u0026subsctn=0","current_through":"2026-01-08 (Statute Update stamp, 3 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:30:13Z","sha256":"047ed720591fea873cee4e316085840e3e01170d9544398b3b05f7a489e37cf0","source_id":"us-pa","stale":false,"prev":"us-pa/3-pa.c.s.-311","next":"us-pa/3-pa.c.s.-313"},"notice":"GroundRules: Original legal text.
