{"data":{"id":"us-pa/4-pa.c.s.-328","jurisdiction":"us-pa","citation":"4 Pa.C.S. § 328","heading":"Penalties.","body":"(a) Suspension or revocation of license.--After a public hearing with at least 15 days' notice, the board may suspend or revoke a licensed operator's fantasy contest license in any case where a violation of this chapter has been shown by a preponderance of the evidence.\n(b) Administrative penalties.--\n(1) In addition to suspension or revocation of a fantasy contest license, the board may impose administrative penalties on a licensed operator for violations of this chapter.\n(2) A violation of this chapter that is determined to be an offense of a continuing nature shall be deemed to be a separate offense on each event or day during which the violation occurs.\n(3) The licensed operator shall have the right to appeal administrative penalties in accordance with 2 Pa.C.S. Chs. 5 Subch. A (relating to practice and procedure of Commonwealth agencies) and 7 Subch. A (relating to judicial review of Commonwealth agency action).\n(4) Penalties imposed under this subsection shall be deposited into the General Fund.\n(c) Civil penalties.--\n(1) In addition to the provisions of this section, a person who knowingly violates a provision of this chapter shall be liable for a civil penalty of not more than $1,000 for each such violation.\n(2) The civil penalty shall be recovered in a civil action brought by the board and shall be paid into the General Fund.","path":["Title 4 - AMUSEMENTS","PART I AMUSEMENTS GENERALLY","CHAPTER 3 FANTASY CONTESTS","SUBCHAPTER C LICENSURE"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=04\u0026div=0\u0026chpt=3\u0026sctn=28\u0026subsctn=0","current_through":"2026-08-05 (Statute Update stamp, 4 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:30:18Z","sha256":"4528c797110e142f2c657a8e0d8978d120accb66ee1ef2384ed4b429188125e9","source_id":"us-pa","stale":false,"prev":"us-pa/4-pa.c.s.-327","next":"us-pa/4-pa.c.s.-331"},"notice":"GroundRules: Original legal text.
