{"data":{"id":"us-pa/42-pa.c.s.-6351.1","jurisdiction":"us-pa","citation":"42 Pa.C.S. § 6351.1","heading":"Authority of court upon petition to remove child from foster parent.","body":"(a) Order required.--Notwithstanding sections 6324 (relating to taking into custody) and 6351(a) (relating to disposition of dependent child), if a county agency petitions the court for removal of a child because the foster parent has been convicted of an offense set forth in 23 Pa.C.S. § 6344(c) (relating to employees having contact with children; adoptive and foster parents), the court shall immediately enter an order removing the child from the foster parent.\n(b) Limitation on placement.--If a court enters an order under subsection (a), the following apply:\n(1) Except as set forth in paragraph (2), the court may, under section 6351(a), enter an order of disposition best suited to the child's safety; protection; and physical, mental and moral welfare.\n(2) Notwithstanding section 6351(a), if the court finds that the foster parent has been convicted of an offense set forth in 23 Pa.C.S. § 6344(c), the court has no authority to place or return the child to the foster parent who was named in the petition filed by the county agency under subsection (a).","path":["Title 42 - JUDICIARY AND JUDICIAL PROCEDURE","PART VI ACTIONS, PROCEEDINGS AND OTHER MATTERS GENERALLY","CHAPTER 63 JUVENILE MATTERS","SUBCHAPTER D DISPOSITION OF CHILDREN GENERALLY"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=42\u0026div=0\u0026chpt=63\u0026sctn=51\u0026subsctn=1","current_through":"2026-08-03 (Statute Update stamp, 42 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:33:14Z","sha256":"b418ad51bf5f58ac2fc44cf62736271934d4e4019db32a8c78a458cb883e8521","source_id":"us-pa","stale":false,"prev":"us-pa/42-pa.c.s.-6351","next":"us-pa/42-pa.c.s.-6352"},"notice":"GroundRules: Original legal text.
