{"data":{"id":"us-pa/42-pa.c.s.-7321.11","jurisdiction":"us-pa","citation":"42 Pa.C.S. § 7321.11","heading":"Consolidation of separate arbitration proceedings.","body":"(a) Conditions.--Except as otherwise provided in subsection (c), upon motion of a party to an agreement to arbitrate or to an arbitration proceeding, the court may order consolidation of separate arbitration proceedings as to all or some of the claims if:\n(1) there are separate agreements to arbitrate or separate arbitration proceedings between the same persons, or one of them is a party to a separate agreement to arbitrate or a separate arbitration proceeding with a third person;\n(2) the claims subject to the agreements to arbitrate arise in substantial part from the same transaction or series of related transactions;\n(3) the existence of a common issue of law or fact creates the possibility of conflicting decisions in the separate arbitration proceedings; and\n(4) prejudice resulting from a failure to consolidate is not outweighed by the risk of undue delay or prejudice to the rights of or hardship to parties opposing consolidation.\n(b) Partial consolidation.--The court may order consolidation of separate arbitration proceedings as to some claims and allow other claims to be resolved in separate arbitration proceedings.\n(c) Agreement governs.--The court may not order consolidation of the claims of a party to an agreement to arbitrate if the agreement prohibits consolidation.","path":["Title 42 - JUDICIARY AND JUDICIAL PROCEDURE","PART VII CIVIL ACTIONS AND PROCEEDINGS","CHAPTER 73 ARBITRATION","SUBCHAPTER A.1 REVISED STATUTORY ARBITRATION"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=42\u0026div=0\u0026chpt=73\u0026sctn=21\u0026subsctn=11","current_through":"2026-08-03 (Statute Update stamp, 42 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:33:14Z","sha256":"4fe7ed713ab474e0552c26deaa87ac9aa131f243621ceeee02451d7cb8fb4a93","source_id":"us-pa","stale":false,"prev":"us-pa/42-pa.c.s.-7321.10","next":"us-pa/42-pa.c.s.-7321.12"},"notice":"GroundRules: Original legal text.
