{"data":{"id":"us-pa/42-pa.c.s.-7405","jurisdiction":"us-pa","citation":"42 Pa.C.S. § 7405","heading":"Collaborative law participation agreement.","body":"(a) Requirements.--A collaborative law participation agreement must:\n(1) Be in writing.\n(2) Be signed by the parties.\n(3) State the parties' intention to resolve a collaborative matter through a collaborative law process.\n(4) Describe the nature and scope of the collaborative matter.\n(5) Identify the attorney who represents each party in the collaborative law process.\n(6) Include a statement that the representation of each attorney is limited to the collaborative law process and that the attorneys are disqualified from representing any party or nonparty participant in a proceeding related to a collaborative matter, consistent with this chapter.\n(b) Optional provisions.--Parties may include in a collaborative law participation agreement additional provisions not inconsistent with this chapter or other applicable law, including, but not limited to:\n(1) An agreement concerning confidentiality of collaborative communications.\n(2) An agreement that part or all of the collaborative law process will not be privileged in a proceeding.\n(3) The scope of voluntary disclosure.\n(4) The role of nonparty participants.\n(5) The retention and role of nonparty experts.\n(6) The manner and duration of a collaborative law process under sections 7403 (relating to beginning the collaborative law process) and 7406 (relating to concluding the collaborative law process).\n(c) Nonconforming agreements.--This chapter shall apply to an agreement that does not meet the requirements of subsection (a) if:\n(1) The agreement indicates an intent to enter into a collaborative law participation agreement.\n(2) The agreement is signed by all parties.\n(3) A tribunal determines that the parties intended to and reasonably believed that they were entering into a collaborative law agreement subject to the requirements of this chapter.","path":["Title 42 - JUDICIARY AND JUDICIAL PROCEDURE","PART VII CIVIL ACTIONS AND PROCEEDINGS","CHAPTER 74 COLLABORATIVE LAW PROCESS"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=42\u0026div=0\u0026chpt=74\u0026sctn=5\u0026subsctn=0","current_through":"2026-08-03 (Statute Update stamp, 42 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:33:14Z","sha256":"593590a4a51fd2812c095f75a520b776473ec075844958608027f0e0233b2ac2","source_id":"us-pa","stale":false,"prev":"us-pa/42-pa.c.s.-7404","next":"us-pa/42-pa.c.s.-7406"},"notice":"GroundRules: Original legal text.
