{"data":{"id":"us-pa/44-pa.c.s.-7311","jurisdiction":"us-pa","citation":"44 Pa.C.S. § 7311","heading":"Hiring report.","body":"(a) Information required to be reported.--If a prospective employing law enforcement agency hires an applicant whose separation records includes any of the following, the law enforcement agency shall file a report with the commission that indicates the prospective employing law enforcement agency's reasoning and rationale for hiring the applicant:\n(1) Final and binding disciplinary action based on any of the following:\n(i) excessive force;\n(ii) harassment;\n(iii) theft;\n(iv) discrimination;\n(v) sexual abuse;\n(vi) sexual misconduct;\n(vii) domestic violence;\n(viii) coercion of a false confession;\n(ix) filing a false report; or\n(x) a judicial finding of dishonesty.\n(2) A criminal conviction relating to conduct described in paragraph (1).\n(b) Electronic database of commission.--\n(1) The hiring report shall be included in the commission's electronic database.\n(2) The hiring report shall be on a form developed by the commission and made available on the commission's publicly accessible Internet website.\n(c) Subject to disclosure.--The hiring report shall be subject to disclosure under the act of February 14, 2008 (P.L.6, No.3), known as the Right-to-Know Law.","path":["Title 44 - LAW AND JUSTICE","PART IV OTHER OFFICERS AND OFFICIALS","CHAPTER 73 LAW ENFORCEMENT BACKGROUND INVESTIGATIONS AND EMPLOYMENT INFORMATION"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=44\u0026div=0\u0026chpt=73\u0026sctn=11\u0026subsctn=0","current_through":"2026-07-29 (Statute Update stamp, 44 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:33:23Z","sha256":"96eb37e76468d6a41ef74dd7680d7e9d91b93b734c4275a29be3ddae3d753f83","source_id":"us-pa","stale":false,"prev":"us-pa/44-pa.c.s.-7310","next":"us-pa/44-pa.c.s.-7312"},"notice":"GroundRules: Original legal text.
