{"data":{"id":"us-pa/51-pa.c.s.-104","jurisdiction":"us-pa","citation":"51 Pa.C.S. § 104","heading":"Character of discharge.","body":"(a) General rule.--Whenever a particular character of discharge is a prerequisite to eligibility for receiving a benefit provided for in this title, an individual must have received a discharge from service under conditions other than dishonorable. Recipients of a discharge under conditions other than dishonorable include the following:\n(1) A recipient of an honorable discharge.\n(2) A recipient of a general, under honorable conditions, discharge.\n(3) A recipient of a discharge under other than honorable conditions for which the recipient has been determined to be eligible for benefits afforded by the United States Department of Veterans Affairs.\n(4) A recipient of a discharge for which benefits are payable under 38 CFR 3.12 (relating to character of discharge).\n(b) Exclusions.--A discharge under conditions other than dishonorable does not include:\n(1) A dishonorable, bad conduct or undesirable discharge.\n(2) A discharge or release because of one of the offenses specified in 38 CFR 3.12(d).\n(c) Uncharacterized separations.--A recipient of an uncharacterized discharge or separation shall be evaluated based upon 38 CFR 3.12(k).","path":["Title 51 - MILITARY AFFAIRS","PART I PRELIMINARY PROVISIONS","CHAPTER 1 GENERAL PROVISIONS"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=51\u0026div=0\u0026chpt=1\u0026sctn=4\u0026subsctn=0","current_through":"2026-08-31 (Statute Update stamp, 51 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:33:58Z","sha256":"287d9d77c8cebbed867387999f37d9cd66dadaf46f5c21bedf734b12d068da81","source_id":"us-pa","stale":false,"prev":"us-pa/51-pa.c.s.-103","next":"us-pa/51-pa.c.s.-105"},"notice":"GroundRules: Original legal text.
