{"data":{"id":"us-pa/75-pa.c.s.-1535","jurisdiction":"us-pa","citation":"75 Pa.C.S. § 1535","heading":"Schedule of convictions and points.","body":"(a) General rule.--A point system for driver education and control is hereby established which is related to other provisions for use, suspension and revocation of the operating privilege as specified under this title. Every driver licensed in this Commonwealth who is convicted of any of the following offenses shall be assessed points as of the date of violation in accordance with the following schedule:\nSection Number Offense Points\n1512 Violation of restriction on driver's license. 2\n1571 Violation concerning license. 3\n3102 Failure to obey policeman or authorized person. 2\n3111.1 Obedience to traffic-control devices warning of hazardous conditions. 2\n3112(a)(3)(i) or (ii) Failure to stop for a red light. 3\n3114(a)(1) Failure to stop for a flashing red light. 3\n3302 Failure to yield half of roadway to oncoming vehicle. 3\n3303 Improper passing. 3\n3304 Other improper passing. 3\n3305 Other improper passing. 3\n3306(a)(1) Other improper passing. 4\n3306(a)(2) Other improper passing. 3\n3306(a)(3) Other improper passing. 3\n3307 Other improper passing. 3\n3310 Following too closely. 3\n3321 Failure to yield to driver on the right at intersection. 3\n3322 Failure to yield to oncoming driver when making left turn. 3\n3323(b) Failure to stop for stop sign. 3\n3323(c) Failure to yield at yield sign. 3\n3324 Failure to yield when entering or crossing roadway between intersections. 3\n3327(a) or (a.1) Duty of driver in emergency response area and in relation to disabled vehicles. 2\n3332 Improper turning around. 3\n3341(a) Failure to obey signal indicating approach of train. 2\n3341(b) Failure to comply with crossing gate or barrier. 4\n(and 30 days' suspension)\n3342(b) or (e) Failure to stop at railroad crossings. 4\n3344 Failure to stop when entering from alley, driveway or building. 3\n3345(a) Failure to stop for school bus with flashing red lights. 5\n(and 60 days' suspension)\n3361 Driving too fast for conditions. 2\n3362 Exceeding maximum speed.--Over Limit:\n6-10 2\n11-15 3\n16-25 4\n26-30 5\n31-over 5\n(and departmental hearing and sanctions provided under section 1538(d))\n3365(b) Exceeding special speed limit in school zone. 3\n(and 60 days' suspension for a second or subsequent offense)\n3365(c) Exceeding special speed limit for trucks on downgrades. 3\n3542(a) Failure to yield to pedestrian in crosswalk. 2\n3547 Failure to yield to pedestrian on sidewalk. 3\n3549(a) Failure to yield to blind pedestrian. 3\n3702 Improper backing. 3\n3714(a) Careless driving. 3\n3745 Leaving scene of accident involving property damage only. 4\n(b) Multiple offenses from same act.--If a driver is convicted of an offense under section 3361 (relating to driving vehicle at safe speed) or 3714 (relating to careless driving), in addition to being convicted of another offense committed at the same time and place, no points shall be assigned for violation of section 3361 or 3714 if points are assigned for the other offense.\n(c) No points after six months.--The department shall assign points to the record of any person within six months from the date of a conviction. Any points assigned after such six-month period shall be null and void.\n(d) Exception.--This section does not apply to a person who was operating a pedalcycle or an animal drawn vehicle.\n(e) Suspension of operating privilege.--In addition to other provisions of this title relating to the suspension or revocation of operating privileges, the department shall suspend for 15 days the operating privileges of any person who for a violation in an active work zone is convicted under:\n(1) section 3361 where the department has received an accident report submitted pursuant to section 3751 (relating to reports by police); or\n(2) section 3362 (relating to maximum speed limits) by exceeding the posted speed limit by 11 miles per hour or more.\nA conviction report received by the department which indicates that the violation of section 3361 or 3362 occurred in an active work zone shall create a presumption that the violation occurred in an active work zone.","path":["Title 75 - VEHICLES","PART II TITLE, REGISTRATION AND LICENSING","CHAPTER 15 LICENSING OF DRIVERS","SUBCHAPTER B COMPREHENSIVE SYSTEM FOR DRIVER EDUCATION AND CONTROL"],"source_url":"https://www.palegis.us/statutes/consolidated/view-statute?txtType=HTM\u0026ttl=75\u0026div=0\u0026chpt=15\u0026sctn=35\u0026subsctn=0","current_through":"2026-08-31 (Statute Update stamp, 75 Pa.C.S.)","vintage":"","retrieved_at":"2026-09-02T16:35:49Z","sha256":"a306473179d9394a813da51717aa37db34161e4d2d3ad463f53bcf123257daea","source_id":"us-pa","stale":false,"prev":"us-pa/75-pa.c.s.-1534","next":"us-pa/75-pa.c.s.-1536"},"notice":"GroundRules: Original legal text.
