Laws § 15-23.1-204","heading":"Simultaneous proceedings.","body":"(a) A tribunal of this state may exercise jurisdiction to establish a support order if the petition or comparable pleading is filed after a petition or comparable pleading is filed in another state or a foreign country only if:\n(1) The petition or comparable pleading in this state is filed before the expiration of the time allowed in the other state or the foreign country for filing a responsive pleading challenging the exercise of jurisdiction by the other state or the foreign country;\n(2) The contesting party timely challenges the exercise of jurisdiction in the other state or the foreign country; and\n(3) If relevant, the other state is the home state of the child.\n(b) A tribunal of this state may not exercise jurisdiction to establish a support order if the petition or comparable pleading is filed before a petition or comparable pleading is filed in another state or a foreign country if:\n(1) The petition or comparable pleading in the other state or foreign country is filed before the expiration of the time allowed in this state for filing a responsive pleading challenging the exercise of jurisdiction by this state;\n(2) The contesting party timely challenges the exercise of jurisdiction in this state; and\n(3) If relevant, the other state is the home state or foreign country of the child.","path":["Title 15 Domestic Relations","Chapter 23.1 Uniform Interstate Family Support Act","Article 2 Jurisdiction"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE15/15-23.1/15-2/15-23.1-204.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:55:39Z","sha256":"ee98f2a5474a37d41fe49b02ea7c833098630c5afa87a9a826a4ed7ce1f0bf7f","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-15-23.1-203","next":"us-ri/r.i.-gen.-laws-15-23.1-205"},"notice":"GroundRules: Original legal text.
