Laws § 23-19.15-12","heading":"Cesspool removal and replacement requirements at property transfer.","body":"(a) Any cesspool found to be serving a building or use subject to sale or transfer shall be removed and replaced with an OWTS or the building served by the cesspool shall be connected to a public sewer system within twelve (12) months of the date of sale or transfer.\n(b) Should the manner of wastewater disposal be unknown, an inspection shall be conducted to determine if a cesspool is present on the property. This inspection shall be done by a system inspector prior to the time of sale or transfer.\n(c) Pursuant to § 5-20.8-13, every contract for the purchase and sale of real estate that is or may be served by a private cesspool shall provide that potential purchasers be permitted a ten-day (10) period, unless the parties mutually agree upon a different period of time, to conduct an inspection of the property’s onsite sewage system in accordance with procedures required by the department in § 23-19.15-5(a), before becoming obligated under the contract to purchase.","path":["Title 23 Health and Safety","Chapter 19.15 The Rhode Island Cesspool Act of 2007"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE23/23-19.15/23-19.15-12.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:56:54Z","sha256":"217e4c544440e80ee62e343ec0cdea4b33bd9dff786af863be78db9b744378e5","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-23-19.15-11","next":"us-ri/r.i.-gen.-laws-23-19.16-1"},"notice":"GroundRules: Original legal text.
