Laws § 23-6.3-14","heading":"Reporting and notification of HIV/AIDS.","body":"(a) Except in the case of anonymous HIV testing, a diagnosis of HIV or AIDS shall be notifiable and reportable to the department by name.\nThe following shall be reported to the department:\n(1) A diagnosis of HIV, according to the most current CDC case definition of HIV.\n(2) A diagnosis of AIDS, according to the most recent CDC case definition of AIDS.\n(3) A positive ELISA result of any HIV test and/or other FDA approved test indicative of the presence of HIV.\n(4) Notification of a perinatal exposure to HIV shall be made to the department regardless of confirmatory testing. A perinatal case report for HIV shall be indicated by two (2) positive polymerase chain reaction (PCR) tests; \u003c 18 months; and/or other U.S. Food and Drug Administration approved tests that indicate the presence of HIV in pediatric cases.\n(b) The following persons shall report information required by this section to the department:\n(1) A healthcare provider who diagnoses or treats HIV/AIDS;\n(2) The administrator of a healthcare facility as defined in chapter 17 of this title who diagnoses or treats HIV/AIDS; or\n(3) The administrator of a prison in which there is an HIV/AIDS infected individual or perinatal exposure to HIV/AIDS.\n(c) A person responsible for the administration of a clinical or hospital laboratory, blood bank, mobile unit, or other facility in which a laboratory examination of any specimen derived from a human body yields serological, or other evidence of HIV/AIDS, including perinatal exposure to HIV/AIDS shall notify the department in a timely manner.\n(d) All positive HIV test results shall be confirmed with a Western Blot or other FDA approved confirmatory test.","path":["Title 23 Health and Safety","Chapter 6.3 Prevention and Suppression of Contagious Diseases — HIV/AIDS"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE23/23-6.3/23-6.3-14.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:56:39Z","sha256":"5615e6b15d909a6d7878e1f5d0c1a2f0e60a16a00144bd592f656cc7a9cb3496","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-23-6.3-13","next":"us-ri/r.i.-gen.-laws-23-6.3-15"},"notice":"GroundRules: Original legal text.
