Laws § 34-41-4.01","heading":"Applicability — Exemptions.","body":"(a) This Article applies to all time shares subject to this chapter except as provided in subsection (b).\n(b) Neither a public offering statement nor the materials required by § 34-41-4.07 (Resale of Time Shares) need be prepared or delivered in the case of:\n(1) A gratuitous disposition of a time share;\n(2) A disposition pursuant to court order;\n(3) A disposition by a government or governmental agency;\n(4) A disposition by foreclosure or deed in lieu of foreclosure;\n(5) A disposition that may be canceled at any time and for any reason by the purchaser without penalty;\n(6) A disposition of a time share in a unit situated wholly outside this state pursuant to a contract executed wholly outside this state, if there has been no offering within this state;\n(7) An offering by a developer of time shares in no more than one time-share unit at any one time; or\n(8) A disposition of a time-share property or all time shares therein to one purchaser.","path":["Title 34 Property","Chapter 41 Rhode Island Real Estate Time-Share Act","Article IV Protection of Purchasers"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE34/34-41/34-IV/34-41-4.01.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:58:53Z","sha256":"8cf3a68b25fd822e5db91725976a5b0ae6d56643790407fdf9d2b1941557598c","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-34-41-3.17","next":"us-ri/r.i.-gen.-laws-34-41-4.02"},"notice":"GroundRules: Original legal text.
