Laws § 40-8.2-9","heading":"Damages for overcharges.","body":"When the cost of the services provided to the patient is being paid under the Rhode Island Medicaid program, any person who knowingly and willfully:\n(1) Charges a patient, or anyone acting on behalf of a patient, money or other consideration at a rate in excess of the rates established by the state of Rhode Island; or\n(2) Charges, solicits, accepts, or receives, in addition to any amount otherwise required to be paid under the Rhode Island Medicaid program, any gift, money, or donation as a precondition of the admission of a patient to a hospital, skilled nursing facility, or intermediate-care facility, or of the continued stay in a facility, shall be liable in a civil action to the patient or person acting on his or her behalf for an amount equal to three (3) times the amount of the charge.","path":["Title 40 Human Services","Chapter 8.2 Medical Assistance Fraud"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE40/40-8.2/40-8.2-9.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:59:27Z","sha256":"3048b1878dd3f90316ced4ee5f62ed262cd5aed9da2718bee2376e6337f484e9","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-40-8.2-8","next":"us-ri/r.i.-gen.-laws-40-8.2-10"},"notice":"GroundRules: Original legal text.
