Laws § 40.1-26-4.1","heading":"Aversive interventions — Prohibitions.","body":"It shall be unlawful for any agency to use prohibited aversive intervention techniques on a person with a developmental disability in the state of Rhode Island. The specific strategies to be prohibited within the context of behavioral treatment interventions include, but are not limited to, the following:\n(1) Noxious, painful, intrusive stimuli or activities that result in pain;\n(2) Any form of noxious, painful, or intrusive spray or inhalant;\n(3) Electric shock;\n(4) Water spray to the face;\n(5) Pinches and deep muscle squeezes;\n(6) Shouting, screaming, or using a loud, sharp, harsh voice to frighten or threaten or use of obscene language;\n(7) Withholding adequate sleep;\n(8) Withholding adequate shelter or bedding;\n(9) Withholding bathroom facilities;\n(10) Withholding meals, essential nutrition, or hydration;\n(11) Removal of an individual’s personal property as punishment;\n(12) Unobserved time-out or room/area solely used for time out;\n(13) Facial or auditory screening devices; and\n(14) Use of chemical restraints instead of positive programs or medical treatments.","path":["Title 40.1 Behavioral Healthcare, Developmental Disabilities and Hospitals","Chapter 26 Rights for Persons with Developmental Disabilities"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE40.1/40.1-26/40.1-26-4.1.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:59:34Z","sha256":"f7b6846ca64bd7b38d55a364239cda2e14f96b6d1f81e15a9d5ff774fa48340a","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-40.1-26-4","next":"us-ri/r.i.-gen.-laws-40.1-26-5"},"notice":"GroundRules: Original legal text.
