Laws § 40.1-8.5-7","heading":"Power and duties of director.","body":"In addition to the powers and duties delineated elsewhere in this chapter and other powers and duties already conferred by law, the director shall:\n(1) Promulgate administrative and fiscal regulations necessary to carry out the requirements of this chapter;\n(2) Plan and coordinate, with the assistance of the boards, the development and delivery of comprehensive mental health services within each service area;\n(3) Establish guidelines for general evaluation procedures to ensure program quality;\n(4) Review each board’s overall plan and budget and approve the expenditure of department funds;\n(5) Provide consultative staff services to each board, as needed;\n(6) Require assurances from each board that no persons within its area are denied service on the basis of race, creed, color, gender, age, disability, or sexual preference;\n(7) Require assurances from each board that no person will be denied service based on the person’s ability to pay, contingent upon the availability of resources;\n(8) Require assurances from each board that hiring of staff, full or part-time, is done without discrimination on the basis of race, creed, color, gender, age, disability, sexual preference, or political affiliation and is in compliance with state and federal laws;\n(9) Provide qualified department personnel under the supervision of the director to monitor implementation of this chapter.","path":["Title 40.1 Behavioral Healthcare, Developmental Disabilities and Hospitals","Chapter 8.5 Community Mental Health Services"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE40.1/40.1-8.5/40.1-8.5-7.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T19:59:32Z","sha256":"d4ab82a7dd9056cc4fb0420077e2efdc44d5c914f86d64e9503add35fa1133fb","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-40.1-8.5-6","next":"us-ri/r.i.-gen.-laws-40.1-8.5-8"},"notice":"GroundRules: Original legal text.
