Laws § 45-6-2.3","heading":"Authorization for cities and towns to promulgate and enforce pretreatment and sewer-use ordinances and regulations.","body":"(a) The cities and towns may promulgate all ordinances and regulations to implement a wastewater pretreatment program. Those ordinances and regulations may include the authority to:\n(1) Impose penalties of up to twenty-five thousand dollars ($25,000) per day per violation for each and every day during which a violation of the ordinance or regulation occurs either through judicial proceedings or administrative procedures established pursuant to this section;\n(2) Seek injunctive relief for any violation;\n(3) Recover damages caused by any noncompliance;\n(4) Obtain reasonable attorney fees incurred by seeking compliance, penalties, or damages;\n(5) Require compliance by all users of the city or town’s sewer system, whether or not the user is a resident of that city or town; and\n(6) Include any other provisions consistent with state and federal pretreatment programs.\n(b) To the extent that this statute conflicts with any other general or public law, this statute controls.","path":["Title 45 Towns and Cities","Chapter 6 Ordinances"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE45/45-6/45-6-2.3.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T20:00:41Z","sha256":"5d5c291170e9cce43aab5116a1bef2a94cefd9eefd2c83d61c4fe24c4241c50d","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-45-6-2.2","next":"us-ri/r.i.-gen.-laws-45-6-3"},"notice":"GroundRules: Original legal text.
