Laws § 46-23.3-5","heading":"Eligible and ineligible projects.","body":"(a) Funds in the Ocean State Climate Adaptation and Resilience (OSCAR) fund shall be used solely for adaptation and resilience projects as defined in § 46-23.3-2.\n(b) The OSCAR fund shall not be used for:\n(1) Mitigating any current, planned, or future projects that degrade, fill, or otherwise destroy coastal, estuarine, or riverine habitats;\n(2) Fulfilling any liability for restoration required by any local, state, or federal agency pursuant to an environmental or public health enforcement action;\n(3) With the exception of culverts as specifically described in § 46-23.3-2(1), elevating, repairing, or replacing infrastructure, or constructing new infrastructure, in its existing location that is experiencing climate change impacts as defined in § 46-23.3-2(3);\n(4) Constructing new, or repairing existing shoreline protection structures; provided, however, that existing shoreline protection structures on public parks may be repaired; and/or\n(5) Constructing roads or bridges.","path":["Title 46 Waters and Navigation","Chapter 23.3 The Ocean State Climate Adaptation and Resilience Fund"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE46/46-23.3/46-23.3-5.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T20:01:11Z","sha256":"cd897560f48d218f79da6119979428d78f74e6515a286d0cf3c6a9aef456bd4b","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-46-23.3-4","next":"us-ri/r.i.-gen.-laws-46-23.3-6"},"notice":"GroundRules: Original legal text.
