Laws § 5-86-16","heading":"Grounds for discipline.","body":"The board has the power to deny, revoke, or suspend any license issued by the department in accordance with this chapter, or to discipline a licensee upon proof that the person:\n(1) Is guilty of fraud or deceit in procuring, or attempting to procure, a license or temporary license;\n(2) Is guilty of a felony or of a crime of immorality;\n(3) Is habitually intemperate or is addicted to the use of habit-forming drugs;\n(4) Is mentally incompetent;\n(5) Is incompetent or negligent in the practice of applied behavior analysis as determined by the Rhode Island applied behavior analyst licensing board;\n(6) Has not fulfilled the required continuing-education requirements as determined by the Rhode Island applied behavior analysis licensing board;\n(7) Has violated the ethical principles governing applied behavior analysts and the practice of applied behavior analysis, as adopted by the board and in force at the time a charge is made, provided that those ethical principles are a nationally recognized standard;\n(8) Has practiced as a licensed applied behavior assistant analyst or has performed the duties of a licensed applied behavior assistant analyst without proper supervision by a licensed applied behavior analyst pursuant to § 5-86-26;\n(9) Has had their license revoked, suspended, privileges limited, or other disciplinary action in another state or jurisdiction, including the voluntary surrender of a license; or\n(10) Has failed to furnish the department or its legal representative information requested by the board as part of a disciplinary action.","path":["Title 5 Businesses and Professions","Chapter 86 Licensing of Applied Behavior Analysts"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE5/5-86/5-86-16.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T16:44:09Z","sha256":"02795fbbd49b0b589ac4927efb9d9eab65bf03852243e55020ea9e0bbceda427","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-5-86-15","next":"us-ri/r.i.-gen.-laws-5-86-17"},"notice":"GroundRules: Original legal text.
