Laws § 6-16-5","heading":"Transfers or obligations voidable as to present creditors.","body":"(a) A transfer made or obligation incurred by a debtor is voidable as to a creditor whose claim arose before the transfer was made or the obligation was incurred if the debtor made the transfer or incurred the obligation without receiving a reasonably equivalent value in exchange for the transfer or obligation and the debtor was insolvent at that time or the debtor became insolvent as a result of the transfer or obligation.\n(b) A transfer made by a debtor is voidable as to a creditor whose claim arose before the transfer was made if the transfer was made to an insider for an antecedent debt; the debtor was insolvent at that time; and the insider had reasonable cause to believe that the debtor was insolvent.\n(c) Subject to § 6-16-2(b), a creditor making a claim for relief under subsection (a) or (b) of this section has the burden of proving the elements of the claim for relief by a preponderance of the evidence.","path":["Title 6 Commercial Law — General Regulatory Provisions","Chapter 16 Uniform Voidable Transactions Act"],"source_url":"https://webserver.rilegislature.gov/Statutes/TITLE6/6-16/6-16-5.htm","current_through":"site files published 2025-08-13","vintage":"","retrieved_at":"2026-09-05T17:10:29Z","sha256":"a05c8e09af24e6c4593f4953a9b1889a15349fa032d1eac27b735cf3956d28a1","source_id":"us-ri","stale":true,"prev":"us-ri/r.i.-gen.-laws-6-16-4","next":"us-ri/r.i.-gen.-laws-6-16-5.1"},"notice":"GroundRules: Original legal text.
