Code Ann. § 16-3-1705","heading":"Electronic mail service provider; immunity; definition.","body":"(A) An electronic mail service provider must not be charged with or have a penalty assessed based upon a violation of this article or have a cause of action filed against it based on the electronic mail service provider's:\n(1) being an intermediary between the sender and recipient in the transmission of an electronic contact that violates this article; or\n(2) providing transmission of an electronic contact over the provider's computer network or facilities that violates this article.\n(B) For purposes of this article, \"electronic mail service provider\" means a person or entity which:\n(1) is an intermediary in sending or receiving electronic mail; and\n(2) provides to users of electronic mail services the ability to send or receive electronic mail.","path":["Title 16 - CRIMES AND OFFENSES","CHAPTER 3 Offenses Against the Person","ARTICLE 17 Harassment and Stalking"],"source_url":"https://www.scstatehouse.gov/code/t16c003.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T06:44:04Z","sha256":"5863b9b45d14915161d7ebe520a804f302915e8f9d384c8e6d1fc0232e20ba35","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-16-3-1700","next":"us-sc/s.c.-code-ann.-16-3-1710"},"notice":"GroundRules: Original legal text.
