Code Ann. § 16-3-840","heading":"Methods of judicial determination of age of child.","body":"When it becomes necessary for the purposes of this article to determine whether a child who participated in sexual conduct was younger than eighteen years of age, the court or jury may make this determination by any of the following methods:\n(1) personal inspection of the child;\n(2) inspection of the photograph or motion picture that shows the child engaging in the sexual performance;\n(3) oral testimony by a witness to the sexual performance as to the age of the child based on the child's appearance at the time;\n(4) expert medical testimony based on the appearance of the child engaging in the sexual performance; or\n(5) any other method authorized by law or by rules of evidence.","path":["Title 16 - CRIMES AND OFFENSES","CHAPTER 3 Offenses Against the Person","ARTICLE 8 Sexual Performance by Children"],"source_url":"https://www.scstatehouse.gov/code/t16c003.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T06:44:04Z","sha256":"1c0a82a9a72779968bb0d5d7431ce81029028782d9b3c126623e503274467884","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-16-3-830","next":"us-sc/s.c.-code-ann.-16-3-850"},"notice":"GroundRules: Original legal text.
