Code Ann. § 30-5-5","heading":"Qualifications for eligibility to serve as register of deeds; quo warranto actions to determine eligibility.","body":"(A) In order to be eligible to serve or continue to serve as the register of deeds, a person must:\n(1) be a citizen of the United States and of this State;\n(2) be a qualified elector of the applicable county;\n(3) have:\n(a) a four-year bachelor's degree from an accredited post-secondary institution; or\n(b) at least four years' experience:\n(i) in the fields of law, real estate, or accounting; or\n(ii) as an employee in a register of deeds office in this State; or\n(iii) as a register of deeds in this State; and\n(c) for an appointed register of deeds, a person must comply with any county requirements not conflicting with the qualifications in this section and the Constitution of South Carolina; and\n(4) not have a pattern of failing to properly record in the time and manner prescribed in Section 30-5-90.\n(B) A quo warranto action may be brought in accordance with Section 15-63-60 to determine a person's eligibility to seek the position of register of deeds or continue to serve as register of deeds.","path":["Title 30 - PUBLIC RECORDS","CHAPTER 5 Recording Generally"],"source_url":"https://www.scstatehouse.gov/code/t30c005.php","current_through":"2025 Session of the General Assembly","vintage":"","retrieved_at":"2026-09-02T06:59:19Z","sha256":"847f5bd57fc3130e6d2a3e711b347760ad898f96e1e9946af883f3d5cba9cffa","source_id":"us-sc","stale":false,"prev":"us-sc/s.c.-code-ann.-30-4-165","next":"us-sc/s.c.-code-ann.-30-5-10"},"notice":"GroundRules: Original legal text.
